Additionally, this project provides in-depth analysis of the case law and rationale that reversed the right to judge the law, along with an explanation that the underlying foundation of this right is the Sixth Amendment and the general verdict, regardless of whether one considers this a right or a de facto power. The key to future reform will be changing the definition of this debate from the pejorative term “jury nullification” to one that reflects the true nature of this hallowed tradition such as “jury conscientiousness” or “moral discernment.”

This PLATO article examines the historical importance of the criminal jury, how that perspective influenced the jury's role in trials, and why this role included the right to judge the law, which is commonly referred to as jury nullification, demonstrating that the legitimate justification for jury nullification still exists today: to provide public checks on oppressive government action and tyranny and concepts of justice.
