Antimiscegenation cases were a site of contestation over Radical Republican and Conservative efforts to define the social, political, and economic landscape of the South following the Civil War and the passage of the fourteenth amendment. I look at the social construction of contesting language and at the judicial resources deployed to contest or justify antimiscegenation law in post-Civil War appellate cases in order to surface the assumptions about variously situated bodies that they presumed. The cases reveal that antimiscegenation sentiment was supported in law, not only through a particular reading of the fourteenth amendment but, significantly through a racialized view of God and nature. God, nature, public policy and racial purity surface frequently as judicial resources to justify the law and eventually to challenge the legitimacy of the law. Whiteness is exposed as a social product with changing parameters and race is shown to be inseparable from other fiercely enforced categories such as gender and class in legal decision making and law enforcement.

520 # $a I track the Colonial American invention, development and broad-based acceptance of antimiscegenation law. The category “white” is revealed as a social product that was built upon the idea of Englishness as white. Through the enforcement of the ethical, the laws shaped not just rules that constructed boundaries between social order and criminality, but the rules of whiteness. The rules were highly gendered and class based. The reward for compliance included valuable material, psychological, and spiritual privileges for those viewed as white who remained within specific parameters.
520 # $a The dissertation is a contribution to the larger project of exploring the processes by which races are constructed and enforced. Through an exploration of antimiscegenation law, I focus upon legal institutions and practices that produced and attached meanings to variously situated bodies that eventually became racialized as white. Utilizing perceptual framework analysis, I draw out interconnected assumptions, interpretive logics, and symbols that interacted to shape meanings assigned to bodies in law. I explore privileged meanings of whiteness within contemporary law and society. Finally, I call for the development of a critical white racial ethics. The success of the ethic is its own demise, the abolition of the ontologically empty category whiteness.
