The Jury Duty Survey results also confirmed a statistically significant (p <.05) difference in PTSD symptoms in jurors whose jury panel deliberated and rendered a death penalty verdict than jurors whose jury panel deliberated the death penalty but whose panel returned a life imprisonment sentence. Survey results also indicated high levels of stress in all capital murder case jurors with no statistically significant difference in PTSD symptoms between death qualified capital case jurors and automatic life capital case jurors.

Therapeutic jurisprudence research has suggested that jury duty may be hazardous duty for some citizens serving the American judicial system. A number of studies have reported observing symptoms in jurors after their jury service consistent with posttraumatic stress disorder (PTSD) and depression. Previous research studies have identified several contributing factors to stress reactions. These factors have included the presentation of gruesome and graphic evidence, media attention, fear of retribution by the defendant, sequestration, the length of trial, the personalities and relationship of jurors to each other, community responsibility, courtroom rules and procedures, and whether jurors must consider the death penalty. The purpose of this study was to focus on one of the identified factors, consideration of the death penalty, to determine whether levels of stress and stress-related symptoms differed depending on sentence outcome.
