Identifying incidents as bias-motivated required the officers that were studied to respect the stories and experiences of minorities and gays and lesbians, groups of individuals who have been traditionally treated quite poorly by the police. Though they had the traditional high degree of discretion to not enforce the law, officers in the unit enforced the law in a way that sought justice for victims, often at the expense of the respect of the white communities in which they were enforcing law and frequently at the expense of their fellow officers' respect. Many officers in the hate crime unit were able to do this because the unit had both a culture and a set of procedures that allowed them to encounter minorities as victims with whom they could sympathize.

The dissertation shows that critics' predictions of the unconstitutional application of hate crime laws, namely the infringement and prosecution of protected speech, have not come to fruition in Center City. Police detectives who are responsible for enforcing the law have developed a variety of mechanisms and routines that allow them to avoid conflicts between hate crime law and the First Amendment. Some of these mechanisms include officers' focus on motivation and action, rather than just speech; their examination of the context of language; their identification of typical non-hate crimes; and their decision to enforce the law strategically.
