Hazing is a virulent problem in American society. Hazing activities, once a behavior associated with adults, is now increasingly confronting the children of our society. This study focuses on hazing occurrences in American high schools. Many states have regulations forbidding hazing, yet hazing activities continue. Understanding the depth and scope of the problem is a start to finding a potential method to stop hazing activities. The purposes of this legal and historiographic study are: to illuminate what action courts have taken when confronted with a violation of a hazing statute, compare state hazing statutes, provide a compilation of high school hazing incidents, determine a school district's liability issues associated with hazing, and recommend areas of study not addressed. Data were gathered through legal records, law journals, law reviews, magazines, newspapers, database services, and the Internet.

The investigation describes the process by which hazing moved from fraternal organizations to high schools. The study illustrates the efforts of school administrators to eliminate hazing activities, and why these efforts are not effective. Despite the inability to halt hazing activities, a court may find a school district liable and financially responsible if a hazing incident occurred to a student.

The outcomes of this study are: an overview of legal responses to hazing, a thorough list of high school hazing incidents between 1905 and 2001, explanations of legal concepts often associated with hazing cases, recommendations for school authorities, a presentation of the 43 state statutes dealing with hazing, and suggestions for further research.

Using court reporters to illustrate the legal responses to high school hazing events, the study offers an explanation as to how court authorities respond to violations of hazing statutes. Several tables present a synthesis of information regarding the hazing statutes in the forty-three states that have laws forbidding hazing. Another table delineates the year a state had a reported hazing incident, and in the cases where a state has a hazing statute, whether the hazing situation occurred before or after the passage of the hazing statute.
