Results of the first analysis yielded case ages of up to 161 % greater than those produced by conventional methods, and demonstrated that the post conviction stage accounted for the longest segment of state level capital case processing. Results also established that post conviction petitions claiming mental health or mental retardation exhibited durations 33 % longer than those that did not. These results suggest that courts and legislatures risk diminishing the scope of litigation activities that protect against excessive punishment of vulnerable populations if they embrace policies that aim to expedite post conviction review.

This dissertation challenged claims that redundant and frivolous appeals sustain delays by asking: To what extent do litigation activities associated with developing mitigation claims of mental retardation or mental illness explain the case processing time of capital post conviction petitions?

Using a consecutive sample of 79 capital post conviction petitions filed in Pennsylvania between January 1995 and February 2001, two analyses were conducted to examine case processing time. The first analysis calculated the case ages from date of arrest to present. The second analysis employed an event history method to measure the associations of various litigation activities and types of claims with the duration of the post conviction stage.
