In response to concerns about public disorder, such as panhandling, squeegeeing and loitering, new laws and by-laws have been enacted that seek to re-order public space. These laws have an eerie resemblance to historical vagrancy law even though they do not directly target status. The enactment and deployment of these laws to attend to public disorder is the process that I call the refashioning of vagrancy.

I explore the manner in which historical vagrancy law has been refashioned in relation to form, substance, and function. Original historical research on Canada's vagrancy laws, from Confederation until the 1970s, forms two chapters. My main focus however, is the function of contemporary vagrancy law in (re)ordering public spaces. Detailed studies of Vancouver and Toronto are included in the thesis, along with analyses of the relevant provincial 'Safe Streets' legislation.

I follow many commentators who have suggested that modern-day vagrancy law is geared mainly towards promoting and maintaining spaces which are conducive to consumption. However, I suggest it is necessary to explore the manner in which (the focus on) consumption is attached to other regulatory techniques. In particular, I explore the way the regulatory techniques (or ideals) of civility and 'community' play an important role in the thinking of, and about, consumption.
