摘要註:	隨著國際貿易越來越發達，商業行為的規範為現今社會最重要的議題。公司名稱尤是表彰公司主體的代表，而公司名稱特取部份更是企業在為各項商業行為時，公司對外形像辯識之用。本文主要以中文及英文公司名稱在現行實務上所發生的爭議為研究重點，其中較常生的問題是公司名稱特取部份被其它企業或同業拿來做公司名稱，或被擅自註冊為商標使用。或是商標權人的商標主體被企業登記作為該公司名稱的特取部份。故公司名稱實務使用上所產生近似、混淆侵權，已造成各企業經營上的困擾，在現行法上所涉及相關商標法、公平交易法、貿易法及民法等保護上需深入作一探討，並結論出公司法在公司名稱涉及侵權且為法院判決侵權成立時，需有規範撤銷公司名稱登記之修法法源。 Due to thriving of international trades, standards of commercial behaviors become the most important issue these days. Corporate names can be used for representation of a legal person, and the dominant portions thereof served for identification and recognition of external image of a legal person, particularly when any of commercial behaviors for the legal person are conducted. This study focuses on the disputes or controversies arisen from Chinese nd English corporate names in practice nowadays, especially the common disputes as the dominant portions of corporate names being taken by other companies or same trades to be their own corporate names, registered as their own trademarks or a third party’s registered trademark being registered as dominant portions of their own corporate names, without consents of original owners of corporate names. Thus, corporate names will cause similarity, confusion or infringements against each other in practical uses, which has resulted in troubles or confusion for operation of a company. This study thoroughly probed into and discussed about the protection of corporate names in existing laws or regulations such as Trademark Act, Fair Trade Act, Commerce Act, Civil Code, etc, and concluded that it is necessary to stipulate the revocation of corporate name registration in laws or bring any amendment of the same as any corporate names involve in infringements and courts issue decisions of infringement.
