摘要註:	吾人之一般商業經濟活動中，關於商品發生瑕疵致生損害事件時有所聞，交易糾紛反覆於日常生活中發生，小至於如一般電腦軟硬體買賣所發生之瑕疵，大到海砂屋等瑕疵建物等；因此關於我國物之瑕疵擔保責任所衍生之問題及實務見解，即為本論文所討論之重點。本研究共分六章節，第一章就全文之研究動機、研究目的、研究方法、研究範圍、研究限制與本文架構作一番說明，以期闡明文章之架構。第二章先介紹物之瑕疵擔保責任概念之發展歷程與歷來理論基礎之演進，次就物之瑕疵擔保責任之法律性質加以詳細介紹；第三章主在於分析物之瑕疵擔保責任之成立要件；第四章則討論物之瑕疵擔保責任之各種效力；第五章本章之論述集中於我國關於買賣物之瑕疵擔保責任各項實例之評析，除以向來有爭議之瑕疵建物買賣問題作為討論外，對日漸興起之軟體買賣亦一併介紹加以分析。第六章則先就物之瑕疵擔保責任之法理及概念過程加以說明，再分別就現行不足之處提出具體修法之建議。 There are some events about flaws in products in economical activities. Most commercial conflicts happen from computer related goods, software and hardware to building, such as海砂屋(sea sand room).Therefore, in this paper I will research and analyze the problems of the concept of production warranty liability and offer my research results. There are six chapters in this research. In the first chapter, it includes research motivation, research goal, research extension, research limitation, and research structure. Next, I will introduce the historical development of the concept of production warranty liability and the related theory, then discuss the legal nature; third, analyze the element of establishment; forth, discuss the influence of production warranty liability; fifth, analyze the examples including the software businesses. In conclusion, I will discuss the jurisprudence and conception procedure of production warranty liability and offer suggestions to improve the law.
