Summary:	宗教行政與政府宗教政策是彼此相關，問題在於政府缺乏完整之宗教法律來遂行其宗教政策，目前唯一與宗教法律係民國18年公布之「監督寺廟條例」，並一直延用之今，該條例已無法因應目前台灣各教爭鳴，多神並奉之宗教發展現況。內政部鑒於上開情況，於46年開始試圖修正「監督寺廟條例」或研訂新法律，終因宗教團體、立法委員及專家對於立法內容、架構、規範及見解仍有許多分歧意見，歷時40餘年終無法完成。本文期待從實際從事宗教行政事務之角度，以監督寺廟條例有關寺院負責人財產管理問題為例，對於宗教管制立法提出探討與建議。 The religious administration and government policies for religion are related . The law about religious policies must be created through the legislative process in order to get legislative authority. However, the problem is that our government lacks the whole religious law to carry out the religious policy. So far only “Temple Regulation Act” in 1929 is implemented. Nowadays, this law is unable to respond to all Taiwanese religions and polytheistic situation. In view of the above circumstances, Ministry of the Interior tries to amend Temple Regulation Act or make new law since 1957. Due to different opinions of religious groups, legislators and experts for the contents of the legislation, structure, norms and insights, the law still can’t be modified until now. This article is focus on a case study of property management of temple representative by Temple Regulation Act from the perspective of actual religious executive so as to provide the discussion and suggestions for religious control legislation..
