台灣地區自民國六十五年公布施行「山坡地保育利用條例」後,即賦與原住民取得保留地耕作權、地上權,並且在繼續使用十年後無償取得所有權。該條例於民國七十九修正原住民繼續使用五年後得無償取得保留地所有權,確認現階段原住民保留地產權個別私有制度。惟實施以來衍生諸多問題,原住民保留地產權制度實有加以檢討之必要。 本研究整理學者專加之文獻,探討原住民保留地政策實施至今所衍生之問題及其對原住民文化傳承之不利,以相關理論依據為基礎,分析學者專家對於原住民保留地產權制度之見解,並以實務上原住民部落共同經營原住民保留地成功之經驗佐證,再加上綜合本研究所有受訪者意見之結論,以確立原住民保留地由部落共同所有制對原住民族發展與文化傳承之重要性。最後,本研究嘗試評析「原住民土地及海域」法草案中有關原住民族土地共同所有制之規定,並探討於現行法令下,原住民族土地實施共同所有制之可行性、其如何實施及實施之範圍,以確認原住民保留地無論在理論上、實務上及現行法令上概具有可行性。經由本研究獲致之結論摘錄如下:一、保留地產權共有制度對原住民族之發展與文化傳承是必要與有利的。二、由原住民族部落成員共同組成原住民族部落團體為保留地產權共有主體; 原住民族部落團體並依「原住民族部落團體法」規定為法人。三、原住民族土地產權共同所有制實施之範圍除傳統領域土地外,更應擴及於尚 未分配之既有原住民保留地。四、政府機關應積極輔導原住民族部落團體,輔助有關原住民族部落團體開發建 設或經營管理所需經費,得由政府主管機關編列預算、訂定相關獎助辦法或 以原住民族綜合發展基金提供貸款擔保支應。 Since the Slope Land Conservation and Utilization Act was announced in 1976, Taiwan has entitled aboriginals to the right of reserved lands with respect to cultivation and superficies and even ownership without compensation after ten years’ continuous use. In 1981, the act was amended to state that aboriginals should be entitled to the right of ownership without compensation after five years’ continuous use, which established the private property system of aboriginal reserved lands. However, since the inception of the system, a number of problems have arisen. Thus, there is a need to reconsider the private property system of aboriginal reserved lands. This study reviews literature of experts so as to discuss the disadvantages of the policy of aboriginal reserved lands and its negative effects on the heritage of aboriginal cultures. We not only adopt relevant theories as the basis to analyze the proposals of scholars and experts on the private property system of aboriginal reserved lands, which is backed up with empirical experience of co-managing aboriginal reserved lands in aboriginal tribes, but also conclude the opinions of the interviewees in the survey. By so doing, we validate the importance of the co-ownership system of the aboriginal reserved lands by aboriginal tribes. Lastly, we attempt to evaluate the draft of Aboriginal Land and Marine Spaces Act with respect to the co-ownership of the aboriginal reserved lands. In addition, under the current law, we explore the feasibility of executing the co-ownership system of aboriginal reserved lands, the implementation of the system, and also the scope of implementation. We verify that it is feasible to implement the co-ownership system of aboriginal reserved lands in terms of both the theoretical and practical perspectives and the current law. The conclusion is presented as follows: I.The co-ownership system of reserved lands is necessary and beneficial to the development and cultural inheritance of aboriginals. II.Aboriginal tribe-based groups comprise all the members of aboriginal tribes as the subjects of rights of the reserved lands; the aboriginal tribe-based groups should be granted the status of legal persons in accordance with the Aboriginal Tribe-Based Group Law.III.The implementation of the co-ownership system of aboriginal lands should be extended to the unassigned but existing reserved areas, in addition to the traditional territories. IV.The government should guide aboriginal tribe-based groups by providing grants in the development, construction, and management of aboriginal tribe-based groups. Moreover, with respect to the granting, the authorities concerned should make budgets, establish the regulation of granting, and support it with the loan supply through the funds of aboriginal development.
