Bruns and Mckinnon(1992)認為考評之目的在於:1)測量及判斷受考者績效表現;2)瞭解受考者個人績效與組織目標間之關係;3)促進受考者能力與成長;4)激勵受考者在工作上的士氣與動機;5)增加主管與部屬的溝通;6)作為給予薪資與陞遷的準則;7)提供作為組織控制與整合之建議。然,法官應否接受考評,在我國爭論許久,其中牽涉到法官審判獨立與身分保障問題。 司法機關的存在目的,在於提供司法給付,透過憲法第8條正當法律程序及憲法第80條獨立法官之確保,保障人民憲法第16條之訴訟權,並藉訴訟權保障確保人民憲法上基本權。惟,學理上及司法實務上均是司法行政事項為司法機關內部工作條件或管理措施之事務,按司法自治與法官自律原則,非法官成員不得過問監督。然,從近來報章媒體不斷紕漏「恐龍法官」、「娃娃法官」、「鍵盤法官」,乃至批判最高法院係豢養恐龍法官的溫床,在在顯示出司法行政事項並非如傳統學理及司法實務上所稱單純司法機關內部工作條件或管理措施之事務,實乃攸關司法給付是否符合人民憲法上訴訟權之確保。故,透過司法行政手段確保法官之公正性、獨立性,確保法院之公平性、程序行使正當性,已是刻不容緩、且應由全民監督之事務。司法院、立法院、法務部終於通過法官法。惟,法官法施行前,我國法官考評制度為何?法官法是否有確實解決法官法施行前之法官考評問題,不無疑問。 本文試圖透過私部門的人力資源管理、行政機關人事行政法治、考權理論與各國司法人事立法例出發,論述司法機關透過人事行政手段達到人力資源管理目的之適當性與必要性。並為傳統學理及司法實務上所爭論者,統整人事行政手段與人力資源管理之限度。尤其利用「矩陣類型化」模型建構,提供人事行政手段與人力資源管理基礎之參考,希冀利用法官考評制度,促使公正、獨立法官之存在、公平法院之確信、正當法律程序之確保。 Bruns and Mckinnon(1992)thought the aim of the qualification is:(1)Measuring and determining the performance of the person who are qualified(2)Realizing the relationship between the person’s performance and the aim of the organization(3)Promoting the person’s ability and progress(4) motivating the person's intention (5)Increasing the communication between the employer and the employee(6)For the rules of giving salaries and promotions(7)Providing the suggestions of how to control and integrate an organization.The aim of the existence of the juridical institute is to provide the juridical payment. According to constitute NO.8 :the positive law process and NO.80:assuring the independence of the judges to ensure the right of the litigation(The constitute law NO.16)and ensure the essential right of people in constitute law by the litigation law. In theory and reality,the juridical administration matter are working conditions and managing methods.According to juridical self-government and autonomy,the members who are not judges can’t supervise.But, the media and newspapers criticize the dinosaur judges,baby judges and keyboard judges constantly,they criticize that the highest court of justice is a nice place of breeding the dinosaur judges.This demonstrate the juridical administration items are not the same as the traditional theory and juridical reality they say the working conditions and managing methods in the pure juridical institutes.This thing is about the juridical payment whether is suitable for the assuring litigation in the constitute law.By the juridical administrative methods,they can assure judges’fair- minded,independent,assuring the fairness of court,the the process is positive or not`,these things we can’t wait anymore.And these things people should supervise.Juridical Yuan, Legislative Yuan and the department of law finally pass the law of judge. But ,before the law of judge be executed.What is our qualification rule?Whether the judges can solve the problems before the law is executed is the question.This paragraph try to use the human resources management,administrative institutes governing by law,the theory of examination and each country’s legislation set out.It describe the juridical institutes use the administrative methods to achieve the suitable and essential aim of the human resources management and help the dispute between the traditional theory and juridical reality.It integrates the limit of the administrative methods and human resources management.Especially using the Matrix Type structure to provide the administrative methods and human resources management as basic reference.Hope that using the A Study of The Court Judges Appraisal Systems can promote the fair and independent judges’existence and assuring the positive law process.
