國際貿易具有跨國性,海上保險亦具備國際化。對海上保險而言,船舶適航性的義務是一個基本且重要的議題。基於保險的歷史背景及公益性考量,海上保險必須在最大誠信原則下運作,此為保險人控制風險的有效手段。保證在海上保險中有其不同於契約法的獨特地位,適航性亦為海上保險的默示保證之一,與海上貨物運送契約中所提及的適航性有不甚相同的意義。船舶適航性在不同的海事法律中,有其不同的責任範圍以及法律效果。1906年英國海上保險法並無就適航性提出判斷標準,然而為掌握適航性的全貌,實務上大多參酌海牙規則、海牙-威士比規則、漢堡規則,以及國際海事組織所制定的統一海事標準。我國海商法對船舶適航性的意義主要是繼受海牙規則相關規定,但是海牙規則的內容大多是針對海上貨物運送而為之規範,若直接援用於海上保險,可能會與國際貿易習慣相悖。1906年英國海上保險法課以被保險人必須提供適航船舶的義務與絕對的責任,歷來已出現許多建議修改的意見,保險實務亦開始運用一些調和的條款。本論文將透過系統的整理,並對我國海商法提出未來修法的建議。 Like international trade, marine insurance is international. Seaworthiness is a significant issue in the marine insurance world. Owing to the historical background and public interests, marine insurance requires to be transacted under the principle of utmost good faith. Moreover, warranty plays an important role in the marine insurance contract, by concluding of which seaworthiness is one of the implied warranties, and its effects are not completely similar to that of the contract of carriage of goods by sea. Notwithstanding different maritime statutes provide different seaworthiness stipulations which involve in the liabilities and effects. Not mentioned by the Marine Insurance Act 1906, the standards with regard to seaworthiness basically are regulated by the Hague Rule, the Hague-Visby Rule, the Hamburger Rule, and the rules enacted by the International Maritime Organization. Hence, an overall perspective of seaworthiness approaches to be seen. The Maritime Act of Taiwan adapted the seaworthiness norms stipulated in the Hague Rule which regulates the cases resulting from the domain of carriage of goods by sea. Thus, applying such norms to the marine insurance operation, it may contradict with the international trade customs. The obligation of the insured to provide a seaworthy vessel is absolute; nevertheless, numerous amendments have been proposed over the years, so several clauses for reconciling have appeared in the marine insurance practice. This thesis may form a basis for suggested guidelines for reforms in Taiwan in the area of maritime law.
