This research project examines the nature of judicial dispute resolution in the Superior Court of Quebec. Results from survey and observation data are reported, which indicate some inconsistencies between theory and practice. In particular, the attitudes and practices of the judges who conduct judicial settlement conferences reveal that despite policies designed to encourage non directive, integrative forms of dispute resolution, judges tend to adopt a "traditional" approach founded in distributive reasoning and an assumption of fixed resources. A comparison of the judicial dispute resolution literature in Quebec and in other jurisdictions reveals a difference in theoretical approach in Quebec, which favours a broader, integrative role for judicial dispute resolution. Yet the practices of judges in Quebec do not fully attain this ideal. In fact judicial practices not uncommonly more closely resemble traditional judicial approaches to settlement put forward for other jurisdictions. Recommendations are given for clarifying the role of judicial dispute resolution at the Court and for encouraging the use of integrative reasoning and an interest-based approach.
