    摘要註: 民國99年至101年3載中,我國勞工保險之職業災害給付,每年平均金額達70億元,平均每年勞工死亡千人率達千分之0.069,耗損國家經濟難以估計。國家須藉社會性立法,始能保障罹災勞工或其家屬之生活照護。職業災害案例層出不窮,職災勞工往往面臨身心靈及經濟上重大考驗,我國目前職業災害之救濟,大體可區分為民法上之損害賠償及勞動基準法之補償,而補償部份又由勞工保險條例之職業災害給付及勞動基準法之職業災害補償和職業災害勞工保護法之各種補助和津貼等所組成,民法僱傭契約因勞務提供具從屬性,受僱人對服勞務無法獨立完成,雙方之權利義務依法律規範而定之。民法因社會政策考量,課以僱用人對受僱人人身安全防護義務,對非歸責於受僱人事由而蒙有損害者應負損害賠償之責任。勞動基準法中勞動契約為民法僱傭關係之特別規定,勞動基準法具公法性質,課以雇主公法上義務,勞動保護法令是以公法性質,賦予雇主安全防護之義務。職業災害防止乃雇主之義務,雇主對其所提供勞工工作之環境、設施有符合勞工安全衛生法之最低標準,即民法184條第2項所稱保護他人之法律之義務。各國職業災害補償採無過失責任制度,只要勞工發生職業災害,不問勞工本身有無過失,雇主即應給予職業災害補償,惟職業災害補償之金額與範圍受限,有關勞工之勞動力減少、精神慰撫金之賠償,須另依民法侵權行為之規定請求損害賠償。本文就我國職業災害之救濟制度做整體性的說明,闡述職業災害救濟制度之生成背景及職業災害救濟制度間法律之適用關係,邇近,職場工作安全衛生普受國人重視,落實勞工之工作安全與健康之保護,為勞工安全衛生法之立法宗旨。雇主提供勞工工作上必要之安全衛生設施更是預防職業災害確保勞工工作安全與健康之積極作為義務,也是降低職業災害發生最有效之作法,探討雇主於勞工安全衛生法上防災作為義務及法律上就勞工職業災害預防之保護安全標準之落實執行,以確保勞工就業安全與健康更是降低職業災害確保勞工權益最大保障作為,故就勞工安全衛生法對勞工生命、身體、健康保護之探究和完善勞工安全衛生法法律規範對預防職業災害確保勞工作業安全規定之探討,對於預防勞工職業災害發生確保勞工安全與健康深具實益,而能助益健全完備保護勞工作業安全與健康法制,並使全國勞工均有安全與健康之工作環境,以達到預防勞工職業災害發生保障勞工生命安全與健康之目的,更是本文探討之目的。 There are average seventy hundreds of millions compensation settlement caused by the occupational injury from the labor insurance every year between year 2010 to 2012 in our country. And the average permillage of labor death every year reached to 0.069 permille, which is hard to evaluate for the economic loss of the country. The country should establish the social law to ensure the life caring of the injured workers and their families.The occupational injury happened emerging in an endless stream, the injured employee have to face to a huge difficulties in physical, mental and economic loss. The relief for the occupational injury in our country has two parts roughly, one is the compensation based on the Civil Law and the other is the indemnity based on the Labor Standards Law. The compensation includes the occupational accident benefits based on the Labor Insurance Act, the occupational accident compensation of the Labor Standards Law and the several kinds of indemnity and allowance of the Occupational Accident Labor Protection Act. The labor service under employment contract in the Civil law is subordinated, when the employee cannot provide the labor service independently, the right and duty of each other follows the regulation of the law. The Civil Law with concern of the social policy, regulating the employer should take the duty of protecting the employee’s safety, and taking the compensation responsibility for the loss of the employee which is faultless.The labor contract in the Labor Standards Law is belong to the special regulation of the employment relationship in the Civil Law. The Labor Standards Law has the character of the public law, which requests the employer take the duty of the public law. The Labor Protection Act based on the character of the public law regulates the employer taking the duty of providing a safety working protection. To prevent the occupational injury is the duty of the employer, who should provide the safe working environment and facilities which reached the basic standard regulated by the Labor Safety and Health Act, which also means the duty of the law for protecting others in the second item of Article 184 of the Civil Law. Nowadays, the compensation for occupational injury follows the strict liability system all the world, which means while the occupational injury happened, whether the employee has the fault or not, the employer should pay the compensation anyway. Alone the amount and scope of compensation is limited, the loss caused of labor’s productivity reduction and the compensation of the spirit solatium should claim by the regulation of infringement act in the Civil Law.This paper is going to make a whole explanation on the relief system of the occupational accident in our country. Here will elaborate the background of the relief system of the occupational accident and the applications among the laws on the relief system of the occupational accident. Nowadays, the concept of the labor safety and health is taken seriously by the public. To implement the protection of the labor safety and health is the aim of the Labor Safety and Health Act's legislation. The provision of the safety and health facilities for workers by the employer is the positive conduct duty for preventing occupational accident and securing labor's safety and health, and also the efficient conduct for reducing the occupational accident. To discuss the employer's prevention conduct duty according to the Labor Safety and Health Act and the exactly implementation of safety standards in the law of occupational accident prevention, in order to secure labor's safety and health and reduce the occupational accident, and further making the most effort on securing labor's right. To researching the protection of labor's life and health and prevention of occupational accident by the Labor Safety and Health Act, which is supporting to prevent the occupational accident and secure labor's safety and health, and further improving the legislation for protecting labor's safety and health and providing a safety and healthy working environment for labor, thus reaching the aim of preventing the occupational accident and securing labor's safety and health. That is the purpose of this paper.
