    摘要註: 本研究旨在以法政策學的觀點分析身心障礙者定額進用制度,由該制度本身出發,向前延伸政策源起與法律制定之間的關係,並以義務進用機關的訪談觀察,對於該制度引領的變革與未來修正方向進行討論。本研究採深入訪談法,並根據研究目的、問題及文獻探討之結果,編製訪談大綱進行訪談,研究者以高雄市某區公所及國民中學之人事主管及承辦人員為研究對象,瞭解身心障礙者定額進用制度之運作現況,主要發現如下:一、身心障礙者定額進用制度之政策認知,包括:政策認知普遍認為係提高身心障礙者的就業率、政府部門本身特性致執行該制度較為確實、身心障礙者工作能力與態度是公立單位較為關注的焦點、公立單位執行身心障礙者定額進用制度有結構面與心理面之困境。二、身心障礙者定額進用制度法律之理解,包括:現行公立單位的進用標準分類過於粗略、公立單位之學校標準與比例應考量實務之執行、公立單位之誘因機制效果有限、公立單位的反誘因機制效果是執行最主要原因。三、身心障礙者定額進用制度執行成效之認知,包括:原高雄縣鄉鎮公所與高雄市區公所因應方式有別、公立中學不足額進用的狀況有其編制及結構性因素、制度並未深刻改變進用之思維。依據以上之研究發現,本研究對於政府部門主管或督導該制度之機關、教育主管機關、勞工主管機關、考選機關與未來研究分別提出以下建議:一、對於政府部門主管或督導身心障礙者定額進用制度之建議:針對政策認知,強化機關首長及公務人員的認知與理解,以建立共識並改變政府機關用人思維。二、對於教育主管機關的建議:正視中小學進用不足額的問題,並思考身心障礙教師甄選單獨舉辦的可能性。三、對於勞工主管機關的建議:除了就業數字的量,在制度設計上應使其朝穩定的「質」發展;對於公立單位的執行,尤其是公立中小學,應多了解實務面的事實。四、對於公務人員考選機關的建議:主動協調勞工主管機關,辦理相關訓練,落實淘汰機制,使得身心障礙人員得以適才適所,並排除不適任人員。五、對後續研究的建議:未來研究範圍可擴及以公立機關、國民小學或其他教育階段之層面。研究方法可嘗試以其他研究方法進行探究,例如無結構性訪談、問卷統計研究等。研究內容方面可擴及其他社會政策或就業安定領域。 The main purpose of the study is to understand the condition of quota system for people with disabilities by the law policy study viewpoint analysis. The researcher probes the resource of the system and understands the relations between the system itself and legal formulation. The study recommends the future change direction regarding this system for employment the institution.The study adopts the in-depth interviews and designs interview outlines according to research purposes, research questions and literature surveys. For data collection and analysis, qualitative research interview method was employed to explore interviews with a total of the personnel human affairs of manager in a Kaohsiung area geographical unit of government and the public junior high school.The findings of this study are as follows:1. The status of quota system for people with disabilities includes: (1)Quota system can enhances the employment rate of people with disabilities; (2)Government department itself carries out this system certainly; (3)People with disabilities working competencies and the manners are the focal point comparatively; (4) The public units which carry out the system have difficulties in structure and psychology.2. The law questions of the system include: (1)The present public unit employment the standard is sketchy; (2)The standard and proportion of the public unit should consider execution; (3)The effect of gravitation to the public unit is limited; (4) The public unit's counter-cause machine-made effect is the execution most primary cause.3.The system execution includes: (1)The responsive styles are different in Original Kaohsiung County villages and towns geographical unit of government; (2)The employment shortage in the public junior high school has its establishment and constitution factor; (3)The system would not change the thoughts for employment.Based upon the findings, some suggestions are addressed for government department manager, educational administrators, labor administrators, examination institution, and future researchers.1. For government department managers, the system should enhance the cognition and comprehension in directors and civil servants; And, the system should establish the mutual recognition and change the governmental agency choosing a person for a job thought.2. For educational administrators, the system should emphasize the employment the shortage condition and consider the possibility about the individual selection of teacher with disabilities.3. For labor administrators, the labor management department should prompt quantity and quality development in the system design stably. Besides, labor administrators should understand the execution question in the public elementary and junior high schools.4. For examination institution, it should provide related training by coordinating labor management department, enact elimination mechanism, and cause people with disabilities personnel to be able the suitable institute.5. For future researchers, the samples should be expanded. Besides, the unstructured interviews and qualitative studies should be adopted to make more in-depth data. And researchers can broaden the research content to social policies or employment stabilization dimensions.
