    摘要註: 鄉鎮市(區)轄內的調解委員會為地方特有之止息紛爭，疏減訴源的制度，法源依據為鄉鎮市調解條例。本條例自民國44年立法實行以來，已經歷10次的修正。隨著鄉鎮市條例之修法，鄉鎮市(區)調解法制之發展，其法理基礎與調解組織和功能上，均發生變化。本論文係從鄉鎮市(區)調解制度概念、意義、功能、法律地位、為基礎，進而敘述我國鄉鎮市(區)調解之現況，如：我國鄉鎮市(區)調解制度之發展、鄉鎮市(區)調解之實務運作、法律效力、和全國各鄉鎮市區調解業務概況，繼而探討道路交通事故案件成效，如：道路交通事故處理流程、如何申聲請調解、調解案件如何進行。以臺南市七股區調解委員會之道路交通事故調解案件為例，向臺南地方法院檢察署檢察官、調解委員會主席和委員、當事人、調解秘書做訪談研究，分析其原因以瞭解其成效及影響因素。最後，依據實地訪談資料分析作成的結論，提出鄉鎮市(區)調解業務建議，為日後道路交通事故調解案件成效的提昇奉獻心力，做為我國鄉鎮市(區) 道路交通事故調解案件、調解法制未來發展之參考。 Conciliation Committee within the jurisdiction of township/city (district) is a specific local institution for ceasing disputes and reducing appeals. “Township/city regulations on conciliation” is its legal basis. Since enforcement in 1955, the Regulation has gone through 10 times of amendment. Along with revision of township/city regulations and development of township/city (district) conciliation laws, the legal bases and mediation organizations and functions also change.This paper describes current situations about township/city (district) conciliation of our country from perspectives of concept, significance, function and legal position of township/city (district) conciliation system, e.g.: development of township/city (district) conciliation system, practical operation and legal validity of township/city (district) conciliation and profiles of township/city (district) conciliation work. Furthermore, it investigates effects of road traffic accident mediation, such as processes of disposing traffic accident, how to apply for conciliation, how to cope with conciliation case, and etc. With an example of road traffic conciliation disposed by Tainan Qigu District Conciliation Committee, this study conducts interviews with procurator of Prosecution Service, Tainan District Court, chairman and members of the Conciliation Committee, parties and mediation secretary to analyze related reasons and find out effects and influence factors.Finally, according to conclusions drawn from analysis of field interview data, proposals for township/city (district) conciliation work are put forward so as to contribute to enhancement in effect of road traffic accident conciliation cases and provide a reference for future development of township/city (district) road traffic accident mediation cases and conciliation legislations.
