摘要註:	兩岸經貿交流日益熱絡，兩岸病媒防治業相關法律規定已逐步建全，為降低兩岸相關專業經貿發展之障礙，進行法規彙整及分析有其必要性。本研究以病媒防治業相關法令要求及管理規定為研究範圍，採用文獻分析法(Analytical Study Method)蒐集台灣地區相關法令資料，主要來源為行政院環保署環保法規查詢系統與行政院環境保護人員訓練所專業技術人員訓練教材；大陸地區法令資料主要來源為中華人民共和國農藥檢定資訊網、有害生物防治員培訓講義與相關研討會之研究資料，運用比較研究法(Comparative Study Method)敘述法規起源、法規演進過程，並依照法令依據、主管機關、法令範圍之比較項目進行研析與比較，最後彙整兩岸現行相關法令資料，進行兩岸之政府組織架構、技術人員教育訓練及產業管理制度之比較，並根據研究結果提出建議，以供相關單位及業者之參考。根據研究結果，兩岸病媒防治政府組織架構，就管理業務職掌，台灣地區中央主管單位為行政院環境保護署，環境用藥管理與各項登記檢定由環境衛生與毒物管理處辦理，大陸地區中央主管單位為中華人民共和國農業部與中華人民共和國國家衛生和計劃生育委員會，環境用藥管理與各項登記檢定由中華人民共和國農業部農藥檢定所辦理；兩岸病媒防治教育訓練資格與訓練內容思維相同之處甚多，但在專業訓練人員分類，台灣地區分為環境用藥製造、販賣及病媒防治業專業技術人員三類，大陸地區分為初級與中級有害生物防治員；新環境用藥申請登記，台灣地區只需向中央主管機關申請查驗登記，大陸地區分三階段進行申請；人員執行業務、工廠設廠標準規定不盡相同，建議可朝落實人員相互認證與建構完善法規資訊方向努力，供相關單位及業者之參考。 A procedure is the economic transactions and regulations relevant to the pest management operation between the Cross-Strait have been gradually developing and maturing. To reduce the barriers in professionally economic transaction and development between the Cross-Strait, relevant regulations must be compiled and analyzed. This study carried out to compare the laws and management regulations relevant to professionals training in pest management operation. Using an analytical study method, we collected information of relevant laws and regulations in Taiwan from the Environmental Law Library system of the Environmental Protection Administration (EPA), Executive Yuan, Taiwan, and the training materials for professionals of the Environmental Professionals Training Institute. The information of laws and regulations in China were collected from the China Pesticide Information Network, training courses for pest management operation, and research information of relevant conferences. We used a comparative study method to describe the origin and evolution of laws. Subsequently, items related to the legal basis, competent authority, and range of laws were analyzed and compared. According to the results, the management of environment agents on both side was respectively the Environment Protection Administration Executive Yuan, Taiwan ,Ministry of agriculture of the Peoples Republic of China and National Health and Family Planning Commission of thr Peoples Republic of China. The education training qualification and training contents regarding pest management operation in Taiwan and China have numerous common in these items. However, regarding the classification of trained professionals, three types of professionals are classified in Taiwan (i.e., environmental agent manufacturers,sellers and pest management professionals); two types are classified in China (i.e., junior- and middle-level pest management operators). The curriculum training and certification were regulated by the EPA in Taiwan, whereas the corresponding affairs in China were conducted by the Pest Control Association. The tasks regulations by the professionals and operators are incompletely similar in the Cross-Strait. There are different rules for different operator in the Cross-Strait. We suggest implementing mutual certification of professionals and establishing comprehensive regulation information, which can be used as references by relevant units and business owners.
