摘要註:	有關減價收受制度，係機關依規定辦理驗收時，廠商未依債之本旨而交付有瑕疵之物，導致驗收不合格之情形，在政府採購法規之設計下，提供減價收受之選擇。首先，減價收受制度之立法意旨係為了避免採購程序延宕及符合經濟效益，在執行成效上，雖能達成上開目的，卻無法確保採購品質。進而在法律面向，政府採購法第72條第2項之條文為不確定法律概念，該法賦予機關裁量之權限，然而在執行上，承辦人員多認為法規範未明，以及擔心圖利罪及其日後衍生之問題，傾向從嚴認定減價收受之條件。因此，本研究依循法政策學之觀點，探討政府採購減價收受制度之發展、法律設計以及地方行政機關執行後之現況進行歸納分析，並以實務案例及個案訪談結果，對於該制度引領之變革與未來修正方向進行討論，以健全該制度之設計，使政府採購減價收受制度更加完備。 The present procedures of work inspection and acceptance require the government agencies to perform inspection before acceptance. The result of inspection indicates nonconformity with the contractual requirement as the defective items delivered by the suppliers. The “Government Procurement Act” in the acceptance with price-reduction designs to offer other options. First, the purpose of the acceptance with price-reduction is to avoid delays in the procurement process and timing and maintain its best economic benefit. However, the procurement quality can not be ensured practically. Second, from a legal-making perspective, under Article 72, paragraph 2 of the “Government Procurement Act” is considered as uncertain concepts when it allows government agencies to make judgments. However, many undertakers concern the ambiguity of the law norms during execution, fear of the crime for profit and other questions so they tend to obey the law strictly. Therefore, the main purpose of this study is to examine the conditions in relation to the acceptance with price-reduction on the “Government Procurement Act” from a legal-policy perspective. The study will discuss the system development, the legal status of the design and implementation of local administration by reviewing juridical cases and case interviews. This paper recommends several changes of future direction regarding the system of the acceptance with price-reduction in order to improve the design of the system and to better the acceptance with price-reduction on the “Government Procurement Act.”
