    摘要註: 本研究旨在研究高雄市立K學校教師在教學過程中,教師及相關人員是否具有風險管理與法律責任的觀念。本研究採用量化研究法,選取分別來自於專任教師、導師及行政人員做為參與研究者,以事先擬定的問卷做為研究工具,來完成本項研究。由分析得知體罰認知對管教方式具有正向顯著影響力,顯示教師對於體罰認知的程度越高,其管教方式越為適宜;體罰認知對班級經營策略不具有顯著影響力,顯示教師不會因為體罰認知的程度高低,而影響到班級的經營。而由差異分析可知,職務不同(教師與兼任行政和導師以及專任教師)在管教方式以及班級經營策略上皆不具有顯著差異。現今的教育都是講究零體罰,身為教育界第一線的教師,對教育教師們一定全力以赴,給孩子們最好的學習環境,但隨著時代的演變,但往往力不從心,人權高漲的年代來臨,而以前行之有年的管教方式,往往成為外界爭議與質疑的焦點,反倒成為教師們在教學上的困境,在現今的社會中,已經不適用了。 The purpose of this study is to explore whether teachers and relevant personnel have the concept of risk management and legal liability or not in the process of teaching. This study implemented a questionnaire survey on different unit of teachers, home teachers, and administrative staff. By analyzing the obtained samples, the major findings are summarized as follows:The corporal punishment cognition has positive and significant effect on disciplining students, The higher the corporal punishment cognition, the more is appropriate on the ways of disciplining students. However, the corporal punishment cognition produces not significant impact on managing classroom, indicating that the degree of corporal punishment cognition will not make any difference for teachers to manage the classroom. By undertaking analysis of variance, the results indicated that duty differences for teachers yield not significant impacts on disciplining students and managing classroom..Zero corporal punishment is emphasized on education nowadays. The teachers in general will try hard to offer a best learning environment to students. Due to time change and the rise of human rights, the old fashion ways of disciplining students become controversial and unacceptable in the modern society. The teachers have to realize this change.
