隨著資訊科技的快速發展,利用相關電子設備來推動電子化政府,已成為提高國家競爭力的重要策略。長期以來,推動電子化政府工作的主要障礙---「身份識別」與「資訊安全」;現行有關電子公文之規範,其電子公文之要件及其送達等並無專法訂定。電子簽章法的立法通過,代表著我國推動電子化政府工作邁入一個新的里程碑。電子簽章法的立法精神,主要在於承認電子簽章與電子文件的法律效力,此意味著未來電子簽章,將可代替正式簽名,但並未對電子文件之送達所生之法律效果有明確之規範;為預防個人資料蒐集、處理或利用所有階段,免受公務機關或非公務機關侵害之危險,並促個人資料之合理利用,而有個人資料保護法(修正前為電腦處理個人資料保護法)之制訂,因此,在加速行政效率的同時,有關當事人個人資料之保護亦應兼籌並顧;以電子文件取代傳統書面而具有同等的法律效力,係行政程序電子化實行之重要期程。執行係行政程序之末端,實不宜投入過多的人力、物力、財力,但對於國家之行政目的達成及社會秩序之維護,因有其存在之功能,故在為縮短其執行之時程及減少行政成本之支出同時,仍應遵守依法行政原則,以保障人民之權益。執行程序電子化係其有關之文書以電子化為之,使受送達人知悉其文書之內容,並以電子送達方式將其送達而生文書應有之法律效果,縮短執行之時程及減少行政成本之支出,亦可減少因當事人並未實際知悉文書內容致錯失救濟時機,而對執行作為有所報怨。本文以行政執行程序為討論之基礎,就有關行政執行程序及其相關文書略為說明,並就現行電子公文相關規範為報告,再就有關文書送達及執行程序使用電子送達為探討後,提出簡略之建議,以期能對執行程序電子化之法制有所助益。 With the rapid development of information technology, use of electronic equipment to promote e-government, Improve national competitiveness has become an important strategy.
