    摘要註: 土地重劃制度係將一定區域內各宗畸零狹小、使用分散之地坵地塊加以整理合併,重新規定其地界及用途,使該區域內之土地適合人類經濟使用之形狀規格與面積之標準宗地單位,再按交換分合方式,分配予原土地之所有權人,以增加該區域土地內之經濟供給,提高土地利用價值之綜合性土地改良。市地重劃常歷時數年甚至十數年,重劃完成之後出售抵費地所得之金錢在實務上不可能等於重劃完成所需之所有支出、成本,當出售抵費地所得之金錢大於重劃完成所需之所有支出、成本,即產生盈餘款,惟公辦及自辦市地重劃盈餘款之分配,似不符合公平原則,如何解決,為本論文研究的目的。本文以文獻回顧法為主,參酌相關文獻分析,先釐清公、自辦市地重劃之區別,分析其法律性質,並將筆者發現的盈餘款分配的問題,套入平等原則及財產權侵害的討論,並以筆者律師生涯實際參與之高雄市第六十八期公辦市重劃及第四十一期自辦市重劃所衍生之相關法律訴訟,探討盈餘款之分配之弊端與漏洞,並進一步提出修法之建議,以保障土地所有權人及改進自辦市地重劃盈餘分配款分配及使用之漏洞。 Department of Land redistricting system will Freaks narrow list of these in a certain area, scatter plots of land mound be consolidated by redefining its boundaries and uses of land in the region to fit the shape and size of human economic use of the area of the standard case ground units, then the exchange switching mode, the original owner of the land allocated to increase the economic supply of land within the region, improving land use value of integrated land improvements. In this paper, literature review based method, taking into account any relevant literature analysis, first to clarify the public, the difference between running the redrawing of the urban land, analyze its legal nature, and the problem I found surplus money allocated, and set into the principles of equality and property rights violations discussion and Kaohsiung career as a lawyer to the author actually involved in the sixty-eighth of Public 41th running the city reclassified and related legal proceedings derived from the city reclassified to discuss allocation of the surplus funds of the disadvantages and vulnerabilities, and The proposal further proposed amending the law to protect the landowners and improve urban land reclassified running the distribution of surplus funds allocation and use of vulnerability.
