    摘要註: 本論文之目的係為探討公共工程爭議與貪污治罪條例第四條第一項第三款間之關係。公共工程常因其成本及施工內容浩大、步驟繁瑣,極易產生爭議問題。又因公共工程涉及政府採購之行為,往往在媒體渲染下,將單純之工程爭議擴張成公務員與廠商貪污舞弊案件,進而將公務員與不具公務員身分之一般人民,捲入漫長的訴訟程序。本文首先從貪污治罪條例之立法目的及緣由進行探討,並與現行實務辦理貪污治罪條例之情形結合。接著探討貪污治罪條例第四條第一項第三款之犯罪類型,並舉以法院判決為例,後再詳細敘述一般公共工程標準流程,及工程各階段之內容。蓋工程實務慣例與工程專業人員之認知判斷,難免因其主觀上對於規劃設計之理念不同,而易有不同之設計類型產生,但相同的是,不論規劃設計如何,必將送請行政機關評選、查核與修正,嗣工程圖說、文件皆經送審通過核可後,方得據以實行。是故在無違反法律規定的情形下,行政機關依法律之授權判斷投標廠商之規劃設計時,應有一定之裁量權限,得依機關之需求訂定工程內容,並以台南高鐵減振案第一審及第二審判決書內容加以佐證。據此,在公共工程各階段皆依政府採購法及相關法令辦理時,既無任何違背法令之行為,司法單位即應予以尊重,除有違法事由外,難再以第三者的立場,針對行政機關所為之行政程序行為適當與否加以審查。最後舉一實際工程爭議之案例,對照公共工程標準流程,及貪污治罪條例之規定深入討論其適法性與適當性,並以工程實務觀點及法律實務觀點加以比較,及於文末提出對於貪污治罪條例第四條第一項第三款之改革看法。 The purpose of this essay is to examine contentions involving the constructions of government projects and their link to Article 4, Item 1, Clause 3 of the Anti-Corruption Statutes. Contentions arise due to the large procurements, the costs of the projects, and themany complicated processes involved. Problems arise when the media makes claims of corruption, illegal payments to government personnel, or favoritism to bidding companies, often resulting in drawn out lawsuits.The essay begins with examining the purposes of the Anti-Corruption Statutes and actual court cases. It will further list and examine precedents set in court rulings against those who have committed offenses involving the Anti-corruption Statutes Article 4, Item 1, Clause 3. The essay will continue with a look at the procedures which must be followed according to the law at each step of the construction processes. Since architectural designconcepts are subjective, the final construction may be different from the original design. Butwhatever the design, all drawings and documents related to the construction project areobligated to obtain government evaluation and approval. As long as the design meets legalstandards, the government’s ability to manipulate the design should be limited. The vibrationreducing project on the Taiwan High Speed Rail may be referenced as one example.Therefore, as long as illegal behaviors have not occurred the legal authorities should respect the involved government department’s decisions concerning construction projects executed within the law. The legal authorities, as a third party, should refrain from unnecessary investigations concerning the properness of government department operations. Lastly, the essay compares an actual contention involving a public construction case in comparison to the standards and procedures established by law. A discussion is included as the appropriateness of the Anti-Corruption Statutes from the perspectives of the construction project as well as the law. A presentation is includes concerning reformation of the Anti-Corruption Statute Article 4, Item 1, Clause 3.
