摘要註:	本研究從違章建築的定義、區分認定、處理流程、依據法令、財產權保障、台灣各地違章建築處理概況，經整理、分析各地方政府面對及處理違章建築的方式、態度，清楚地了解目前台灣地區違章建築存在的真實情況，但因違章建築存在普遍與複雜成因的特性，導致地方政府進行相關違建拆除工作時，雖依中央頒布之建築法及違建管理辦法執行，但其相關規範仍不夠周全，使得地方政府的違章建築管理仍是成效不彰。本研究從違章建築管理相關文獻回顧與評析、違章建築現況特性分析、違章築業務現況分析及執行成效，評估透天住宅違章建築形成的原因，並從法制面、社會面、經濟面及執行面等影響層面找出違章建築的問題，且透過違章建築處理的思考邏輯、違章建築執行相關人員訪談進行驗證，提出高雄市初步的違章建築處理的課題與對策：一、法制面：存在著制度面爭議及社會獎懲機制混亂的議題，可透過修法給予違建物合法財產權，以市場機制化為重點，建立正面的社會獎懲機制，並違章建築的型態分別進行處置。二、社會面：存在著社會同情與批判、違建處理的予盾性、社會結構變遷等議題，可透過違建處理判定準則、溝通、安置與就業、違建治理細分、宣導與放寬等策略進行改善。三、經濟面：可採取違建拆除認定與相關都市計畫、建築管理及消防法規及新舊市區違建標準必要的檢討，針對拆除費用給予一定利率的補貼，以改善經濟層面的違建問題。四、執行面：違章建築存在著執行效率不彰、違建行為複雜等問題，可以違建行為者是否佔用公有土地與是否屬於弱勢族群兩個不同面向進行改善。 After decades, building violation can not be treating with municipal measures, even though several regulations have been promulgated by central administration. Therefore, researchers of building violation have often suggested that preconceived issues about definition of subject, treatment processes, national laws, and the attitude of municipal government. However, this research, which has empirically documented the link between the aspects of social convention and economical condition after undertaken sufficient literature reviews and field studies in the historic settlement of row houses in Kaohsiung, focus on the vulnerabilities in the strategies of building-violation proofing. Therefore, the aim of article attempts to explore the scoop of treatment which abstracted from following studies：1. Legal aspect: there are controversial on the punishment mechanism that is not useful in forbidding building violation. It is possible to give the legitimate property right to the illegal constructions, establish a positive social rewards and punishment system based on the market mechanism, and then act separately according to the different types of illegal constructions. 2. Social aspect: There are problems of social sympathy and criticism, contradictions of coping with illegal constructions and changes of social framework. The improvement strategies could be established of judgment criteria of treating illegal constructions, communication, placement and employment, detailed classification of governance of illegal constructions, as well as promotion and loosening up the regulations.3. Economic aspect: The boundary of demolition in illegal constructions and the related urban planning are necessary evaluated by construction administration 、firefighting regulations and standards of illegal constructions in newer and older parts of the city, allowancing of demolition costs in order to improve the economic aspects regarding the illegal constructions.4. Execution aspects: Bad implementation efficiency and complex behavior of illegal constructions can be improved based on the matter, whether the illegal constructions belong to those who occupy public lands or disadvantaged groups whether the illegal constructions belong to those who occupy public lands or disadvantaged groups. The method with professionals interviewing which related authorities for implementation of demolition of building violation regarding the application of design methods, with the purpose to verify the effectiveness of countermeasures to solve the problems of illegal constructions and reduce the generation of illegal constructions, hoping to be a help of improving the system of dealing with illegal constructions in the future.
