摘要註:	獨立機關一詞非我國固有名詞，其源自於美國的獨立管制委員會，在我國行政機關中是一種新的行政組織。國家通訊傳播委員會被設計作為一個獨立的行政委員會，以保障其在個案上的決策獨立，所要面對的挑戰就是，此種新興的組織型態，是否可容於我國憲政的框架底下，尤其是來自於權力分立與責任政治原則的挑戰。本文希望藉由組織面以及救濟面來討論相關的議題，使得國家通訊傳播委員會能充分發揮其獨立性，達成組織目標。 Independent agency this word is from the Independent Regulatory Commissions of America. Independent agencies in our country is a newadministrative organization. NCC is designed to be one independentadministrative commission granting it autonomy to make impartial policyfor each single case. The unavoidable question is whether suchanewly-developed organization is constitutional under Taiwan's constitution structure, especially to survive the examinations of the Principle of Separation of Powers and the Principles of Politics of Accountability. I hope to discuss organizations and administrative remedyof NCC. In order to achieve organizational goals.
