    摘要註: 國內目前都市更新條例所制定的政策工具中,權利變換為法令政策下所鼓勵使用的工具;而以權利變換的立體分配本質而言,對於都市土地使用效率提升與創造多元化分配型態選擇,具有一定程度助益;但在「台北市士林區文林苑都市更新案」的社會事件爆發後;彰顯出權利變換作為都市更新開發工具造成的爭議,在於更新後資源分配,大多以地主及開發商為主要考量;因此,對於捷運場站週邊舊聚落地區,能否使用一般政策工具,也備受質疑。而本研究動機,主要透過土地分享(Land Sharing)策略,作為權利變換的另類替代工具;並經由模擬試算,探討其可行性。而擬達成之研究目的,於本研究實證地區高雄市前金區林投里透過「大眾運輸導向發展」(TOD,TRANSIT -ORIENTED DEVELOPMENT)的環境定位與複合使用發展(MXD,mixed-use development)的加值輔助下,以土地分享(Land Sharing)策略為主要操作方式;並在解決安置與更新資源分配前提下,透過林投里舊聚落更新地區被安置對象(利害關係人)類型與數量探討;以建立安置與更新資源分配之最小需求關鍵量體(Minimal Requiement Critcal Mass),並由財務初步平衡與用地取得面向,以再細分(Re-Subdivision)方案模擬,提出概念式的解決方案。在經本研究成效益分析結果,初步試算在土地分享制下,完成安置計畫後,其利得約於18億;亦證明土地分享策略運用於林投里地區的都市更新事業,是具有適用性並且可行。 Domestic policy tools developed by the Urban Renewal Act, the right to transformthe statutory policy to encourage the use ofTools; terms of the right to transform three-dimensional distribution of the nature of social Wenlin Yuan, Shihlin District, Taipei City Urban Renewal Case for the type of urban land-use efficiency and create a diversified allocation choice, to a certain extent useful; after the outbreak; highlights the right to transform the controversy caused by the development tools as urban renewal is that the updatedresource allocation, most of the landowners and developers as the main consideration; MRTstations surrounding the old settlement areas, the ability to use the general policy tools, butalso highly questionable.The motivation for this study, primarily through Land Sharing strategy, as the right to transform alternative alternative tools; and count through the mock trial, to explore its feasibility. Assisted research purposes, the environmental positioning of the TOD (TRANSIT-ORIENTED DEVELOPMENT) and MXD (mixed-use development) in this study, empirical Area District, Kaohsiung City Lintou through value-added to the Land Sharing strategy as the main mode of operation; in solving the resettlement and updating the resource allocation under the premise of the resettlement of objects (steak holder) type and quantity of the renewal area through the old settlement Lintou; to establish the resettlement and updating the resource allocation of the Minimal, Requiement Critcal Mass. initial balance and the financial and land acquisition-oriented simulation animation, Re-Subdivision program proposed conceptual solution. By this study into the benefit analysis of the results of preliminary spreadsheets in a land sharing system, the completion of the resettlement plan, and its profits at about 1.8 billionNT; also show that the Land Sharing the strategies used in the areas of the urban renewal business LintouWith the applicability and feasible
