本研究旨在研究高雄市立國昌國中籌辦校外教學活動的過程中,教師及相關人員是否具有風險管理與法律責任的觀念。本研究採用文獻分析及質性研究法,選取分別來自不同單位的教師、導師與行政人員為參與研究者,以事先擬定的訪談大綱為研究工具,完成本項研究。研究發現與建議如下:(一) 相關人員角色明確。(二)意外事故處理流程明確。(三) 教師對法律責任的認知較缺乏。(四) 教師面對法律責任的態度很積極正面。(五) 校外教學費用偏高。(六)校外教學遵守法令公文辦理。(七)校外教學的意外風險以「預防」為主。(八)籌備流程尊重全體民意。(九) 校外教學內涵的設計未考量教育意義。 而根據研究結果,研究者提出研究建議如下:(一) 主管機關應協助設計更具教育意義之行程。(二) 主管機關應提供相關意外案例與處理方式。(三) 應辦理風險預防與法律知能的研習。 The purpose of this study was to explore in the process of organizing the outdoor education of junior high school, the related personnel have the concept of risk management and legal liability. The study was a literature analysis and qualitative research. The advisers who came from different unit of teachers, home teachers and administrative staff had been selected as research participants. And take the interviews with pre-prepared outlines as the research tool to complete this study. The findings of the research are as follow: 1. Educational activities should play a part in outdoor education .2.Exactly follow the law, decrees, and rules when holding outdoor education. 3.Focus on prevention above all in the risk management strategy. 4.Respect public opinions during the preparatory process of outdoor education. 5.The roles of the related personnel are quite clear. 6.The process of dealing with accidents is quite positive. 7.Teachers' understanding towards their legal responsibilities in outdoor education is obviously lacking. 8.Teachers' attitudes towards their legal responsibilities in outdoor education are quite positive. 9. Outdoor education is lacking of educational activities. 10.The expense is too high that cause some students can’t afford.According to the results of the study, some suggestions are listed as follows: 1. Official government organizations can help plan the course which is more educational. 2.Official government organizations should provide the cases of accidents and the solutions for schools. 3.Provide more workshops about risk management and the legal liability.
