    摘要註: 水源保護區之劃設種類繁多其劃設目的也有所不同,因此造成了各項土地使用上的限制,影響當地居民生活、生產,並且對當地的生態同時造成一定的影響。水源保護區的劃設以土地管理而言是為「特殊分區」的管制手段,架構於都市計畫的土地使用分區管制系統之下,由於法令與制度的位階、型態有所不同造成了管理與制度層面上的衝突,進而對於水源保護區內部原有居民、土地所有權人及相關權利關係人在土地使用上的「限制」與被「剝奪感」。本研究探討烏山頭水庫因重疊分區產生土地使用管制的損害補償,以烏山頭水庫風景特定區的範圍為基礎,烏山頭風景特定區內部各主管機關如經濟部水利署、行政院環境保護署、行政院農業委員會劃設相關保護區。多功能性且重疊管理的分區型態,造成居民、土地所有權人與相關權利人受限於土地使用的管制,然而原先的土地使用管制作為,無法合理保護水質水量,保護水源特定區內土地使用權益,因此本研究要探討重疊分區的土地使用限制與補償的目的如下:一、利用歷史分析法探討烏山頭水庫形成重疊分區管制因素與限制內涵。二、以利用歸納法針對國外水源保護區、風景特定區等土地使用限制補償的方法與作為。三、透過類比法分析國內外水源保護區或土地使用管制的補償方式。四、透過個案研究分析,探討烏山頭水庫風景特定區土地使用限制內容與合理的補償方式。最後在個案研究中以烏山頭水庫為案例,透過環境現況分析釐清烏山頭水庫風景特定區內環境、生活、產業與土地使用管制現況問題,建議除了現行保護區之範圍,補償方式除以現金、地方建設回饋金外,建議搭配保育地役權、國民信託制、土地儲備制與發展權移轉,保有補償制度的彈性,合理補償土地使用限制的損失。 It causes restrictions in every land use consequently and it has impacts on the life and production of local residents, and also the ecology because there are various kinds of designating water source conservation areas, and the goals of designation are different. It is a “particular allocated area” of designating water source conservation areas as land management which is built under the zoning systems of urban planning. Owing to the different levels and patterns of regulations and systems, it will have conflicts on management and system. Thus, the original inhabitants, landowners and relative power relation people who live in the water source conservation areas will have the “restrictions” and “the feeling of being deprived” on land use. The research is a discussion on the indemnity of Wusanto Reservoir about land use which results from overlaying zoning. And, it is based on the scope of Wusanto Reservoir Scenic Area; moreover, the every internal authorities of Wusanto Reservoir Scenic Area such as Water Resources Agency, Ministry of Economic Affairs, Environmental Protection Administration, Executive Yuan and Council of Agriculture, Executive Yuan designated relative conservation areas.The multifunctional and overlaid management zoning lead to zoning that residents, landowners and relative power relation people are limited to. Nevertheless, the origin zoning can’t reasonably protect the quality and quantity of water, and the land use right which inside the water source areas. As a result, the following are the purposes of this research discussed about zoning restriction and compensation of overlaying zoning: First of all, it takes Historical Research Method to discuss overlaying zoning reasons and limited intensions which Wusanto Reservoir became. Secondly, it aims at compensations of zoning restriction methods and actions of international water source conservation areas and Scenic Area by System Analysis. Thirdly, it analyzes domestic and international water source conservation areas or the compensations of land use restriction by analogy method. Fourthly, it discusses the contents and reasonable compensations about land use restrictions of Wusanto Reservoir Scenic Area through analyzing case studies. Ultimately, it takes Wusanto Reservoir as an example in the case study, and it clarifies the environment, livelihood, industries and zoning problems inside the Wusanto Reservoir Scenic Area through current environmental condition analysis. It proposed that it should collocate Conservation Easements, National Trust, land banking and Transfer of Development Rights(TDR) besides the range of current conservation areas, and the compensation systems of cash and local construction reward to remain the flexibility of compensation systems and reasonably compensate the loss of land use restrictions.
