摘要註:	在知識經濟年代下,專利訴訟對於法律與管理領域間存有密不可分之關係。管理者面對不可預測與複雜的專利訴訟回應之決策行為,有諸多考量。本研究旨在探討組織剩餘、策略雄心及策略比擬對專利訴訟回應決策之關係。本研究根據計劃行為理論為基礎,建構管理者對專利訴訟回應之心理認知模式。本研究參照競爭行為理論與資源基礎理論,探討組織剩餘對於專利訴訟的回應決策。再者本研究嘗試探討管理者策略雄心的人格特質與專利訴訟回應決策之關係。最後管理者使用相似策略比擬對於回應專利訴訟的決策之影響。本研究以實驗設計的方式,對259位在台灣的中高階經理人進行情境問卷發放。本研究結果顯示,組織剩餘、策略雄心及策略比擬對專利訴訟回應決策有直接顯著的影響。且本研究更進一步證實,當管理者認為擁有較豐沛的組織剩餘時,偏好反擊的可能性意圖越高時,也更願意在專利訴訟時做出反擊的決策;當管理者具備雄心策略時,傾向反擊的可能性意圖越高時,也更願意在專利訴訟時做出反擊的決策;管理者偏好使用策略比擬作為決策的參考依據,且偏好反擊的可能性意圖越高時,也更願意在專利訴訟時做出反擊的決策。 In today's business domain, patent litigation has become a trend in legal, economical and strategic behaviors. In business strategy field, numerous researches on patent litigation remain fragmented. Scholars are aware that managers' decision on reactive patent litigation is important when encountering patent litigation. In addition, few studies highlight the importance of legal issues to explore the related managerial decisions. Thus, this study uses organizational slack, strategic intent and strategic analogy to form specific conditions in experimental scenarios. The purpose is to explore how organizational slacks, strategic intent influence and how to analogy is similar lawsuit based upon decisions in reactive patent litigation practice. We distributed the situation questionnaires to 259 senior managers by using experimental design approach. The results showed that, organizational slack, strategic intent and strategic analogy have direct significant impact in response to patent litigation strategy. The research further investigate: When managers possess rich organizational slacks, will results in high possibility of reactive patent litigation decision through high intention of reactive litigation; When managers possess high strategic intent will affect the intention of reactive litigation which will result in high possibility of reactive patent litigation decision; When the managers tend to use strategic analogy as reference, the high intention of reactive litigation will result in high possibility of reactive patent litigation decision.
