個人資料保護法(以下簡稱個資法)的施行,對於高度使用個人資料的保險業衝擊極大,除了要面對龐大的客戶資料管理與保護外,影響最鉅的業務莫過於客戶名單的行銷策略與陌生名單的開發運用,前者強調既有客戶的二次行銷;後者重視透過準資料庫的建立進而開發市場;但在個資法基於避免人格權受侵害的立法精神下,要求企業對於個人資料之蒐集、處理或利用應尊重當事人之權益,並且要以誠實及信用方法為之,而且不得逾越特定目的之必要範圍,同時也規範首次行銷應提供當事人表示拒絕行銷之方式,這些增修的法令對於強調以客戶資料庫為基盤的保險行銷業者,形成無比的壓力。 本文以傳統的中小型保險經紀人公司(以下簡稱保險經紀人)做為研究主體,剖析個資法施行後,業者面臨法令遵循的困境與衝擊。期以透過保險經紀人的功能、法律地位,以及業務發展對個資高度依賴之角度,擬制業者因應個資法之策略,包括「如何讓個人資料的蒐集、處理、利用合法性」、「委外機關與員工守法的監督」以及「個資防護計畫應注意之事項」等。此外,避免個資保護議題無限擴張、嚴重影響業者競爭力,本文也針對法令規範的不明確或是執行的窒礙難行,分析探討並提出建議,冀許主管機關能考量實務現況,調整監理方式、修訂法規。 The implementation of Personal Data Protection Act (hereafter referred to as PDPA) is impacting to Insurance industry that uses personal information highly. In expect ion with facing management and protection to client data, the most influent business is planning promotion strategy and developing prospective clients. The former one is focusing on 2nd selling to existing customers, and the other one is aiming to potential market development on basis of database creating. In view of the spirit of PDPA that avoids personality infringed, Insurance is asked respect the parties' interest; perform in accordance with the means of good faith, and not excess specific purpose while collecting, transaction, and utilizing personal information. In parallel, PDPA specifies Insurance representatives have to provide the cancellation method of initial marketing to parties. The implementation of those amen dances have Insurance business that is supported by client database perform in high stress. The study is aiming to investigation of Insurance Brokerage Agency (as Insurance Brokers) to analyze what predicament and impact Insurance Brokers face after execution of PDPA, and expecting to scheme countermeasures against PDPA based on Insurance Brokers' job function, legal position, and business development. The countermeasures include to legalization of gather, transaction, and utilization of personal information, supervision of outsourcers and employees, announcements of personal information protection plan, and so on. Furthermore, in order avoidance of unlimited applicability to the topic of personal data protection and influence of business competitiveness, the study investigates if there are any unclear or difficult to implement legal acts and then provides suggestions to relevant Departments who may take them into consideration to align and amend the act. |
