The purpose of this research project was to analyze the deficiencies in International Humanitarian Law (IHL) in the classification of cyber operations during military conflict and the risks associated with irregular or volunteer armies. IHL sets an internationally agreed upon standard for how warfare should be conducted and identifying combatants and their functions in conflict, both international and non-international. Despite the set guidelines and categories of warfighters, cyber capabilities and the ease with which civilians can participate in armed conflict through cyber operations blurs the line of combatant status. The IT Army of Ukraine represents the first militia group to operate exclusively in cyberspace using international civilians. The research explored IHL and if the IT Army should be considered a legal militia under IHL and the potential consequences if the group is found to be illegal under IHL. This research project provides a brief timeline of how cyber operations using civilians has evolved from nations using unorganized civilians and criminal groups to an organized, state-controlled militia. Finally, the research paper highlights the necessity of updating existing terms within IHL to account for similar cyber militias which aim to follow the IT Army of Ukraine’s example in future conflicts.
