Summary:
政府為了回歸市場機制,國營事業民營化屬於國家重大政策,考量未來發展趨勢及需要,宜對所屬國營土地妥為規劃檢討。事業單位必須針對擁有土地進行資產活化利用,為了提高強度使用,透過土地使用分區變更,提升土地的價值。而其中變更過程,涉及捐贈回饋負擔比例問題,由於各地方政府要求完全不同。故如何取得雙贏的情境,是本研究探討目的。本文以質化(定性)分析為導向,透過專家學者深度訪談方法,研究國營事業資產營運之現況,對搜集國內分區使用變更回饋制度規定作系統性分析,透過國內、外對於回饋負擔及開發影響費相關文獻探討,建立研究主題架構與流程。以土地分區使用變更方式研擬,探討回饋負擔,再經由個案為例分析詮釋相關研究內容,最終據以導出合法、合理回饋制度。國營事業土地分區使用變更回饋負擔比例,建立在都市治理總量管制,並且考量土地取得成本負擔與沿革,座落區位等有所不同,基於齊頭式平等的回饋負擔比例不合理的範疇。所以本研究有關回饋負擔是追求在正當性、合理性、合法性之下,應盡義務及責任。提供地方政府及國營事業,在土地分區使用變更之參考。 To return to the market mechanism, the government, considering future development trend and demand, had better review and plan for the land owned by the state-run businesses adequately since the privatization of the state-run businesses is one of the major national policies. The businesses have to carry out the asset activation and utilization of their own land. And to enhance the strength of land use, the businesses have to raise land value through land use rezoning. On the other hand, the rezoning process involves the sharing proportion problem with donation feedback responsibility due to that there are various absolutely different requirements by various local governments. Therefore, how to lead to a win-win situation is the purpose of this study.In this study, qualitative analysis oriented, the current situation of the asset operation of the state-run businesses was investigated through in-depth interviews with scholars and experts. Collection and systematic analysis of the regulations of the domestic land use rezoning feedback systems were conducted. The structure of the study theme and the study procedure were built through relevant global literature discussions on the feedback-responsibility sharing and the development impact fee. By planning with the ways of land use rezoning, feedback-responsibility sharing was explored. And then relevant research contents were analyzed and interpreted through case study. Finally, a lawful and reasonable feedback system was induced.The sharing proportion of the feedback-responsibility for the land use rezoning of the state-run businesses was based on the total amount control of urban governance and considered the differences of the cost responsibility sharing on land obtaining and the land history and location zone in addition to considering the unreasonable range of the feedback-responsibility sharing proportion based on formal equality. Therefore, the feedback-responsibility sharing advocated in this study is an obligation and duty pursued under legitimacy, reasonableness and lawfulness and can be a reference for the government in land use rezoning.
