This dissertation examines the use of protectionist narratives inside American obscenity law as they impinge on the cultural construction of gender, sexuality and law. It is particularly interested in the British court case <italic> Regina v. Hicklin</italic>, and the United States Supreme Court case <italic> Roth v. United States</italic>. In each instance this dissertation examines how the use of protectionist discourse serves to silence women and empower those scripting the narratives around these court decisions.

520 # $a This dissertation offers a cultural history of the medical, political, social, economic, religious, and cultural discursive structures which worked to locate sexually explicit materials as problematic and in need of policing. It begins its examination of history in the seventeenth-century and winds its way to the mid-twentieth-century.
520 # $a This dissertation then offers a detailed examination of the written decision for <italic>Roth v. United States</italic>, and the oral transcript of the Supreme Court trial. <italic>Roth</italic> is a landmark case, not only because of its legal implications, but because it writes out of United States law, in relation to obscenity, the use of protectionist discourse as a reason to censor sexually explicit materials. After <italic>Roth</italic> as a society, we could not use the protection of women as a reason to censor texts. Culturally, this helped empower women to become agents of their sexuality.
