From the comparison of the political thought and political speech cases of Canada and the United States from 1900 to 1999, it would appear that the political thought of a democratic country in terms of how it conceptualizes the individual, the state, and their relationship does affect freedom of expression law. Individuals will be granted greater freedom to express themselves in countries such as the United States where there is both faith in the individual and a fear of the state. In countries like Canada where society is emphasized and there is less distrust of the state, individuals will be expected to defer to society when their speech is seen as threatening the social order or harming other individuals. This study also suggests that it is not the contemporary political thought necessarily but the broader, deeper thought or themes running through the contemporary thought of a country that affects freedom of expression law.

520 # $a In working democracies, a tension exists between liberty—the desire of individuals to freely express themselves without fear of government interference—and authority—the desire of the state to restrict expression to protect public safety and welfare. The general purpose of this dissertation was to explore that tension and its affect on freedom of expression law through a comparative analysis of Canada and the United States. Specifically, the dissertation examined how the political and legal theorists and philosophers in the two countries conceptualized the individual, the state, and their relationship over the course of the twentieth century. After determining the major trends in the political thought of both countries, political speech cases at the supreme court level from 1900 to 1999 in the two countries were analyzed for evidence of reflection of those trends in the decisions. For the purposes of this dissertation, political speech was defined as criticism of public officials and policies, including speech advocating forcible overthrow of the government or incitement to violate democratically enacted laws.
