I conducted five case studies of organizations in the United States and Austria. These organizations were selected based on similar industry (pharmaceutical), size (about 56 employees) and gender composition (about equal). I collected data at two levels. First, I examined aspects of the organizational context through interviews with organizational decision makers and through company documents. I found that rather than merely passive recipients or legal strategists, these managers were active participants in creating the cultural-legal standards that regulate sexual harassment within the firm.

520 # $a Second, I designed and distributed surveys to employees in each of these firms. I found that in addition to the influence of national context, and to a lesser degree socio-demographic characteristics, individual understandings of law and the implementation of law are profoundly influenced by the organizational context. Faced with legal ambiguity, employees are willing to defer to the rules of the organization in determining whether conduct is considered. Further, employee support for internal action against “lawbreakers” and support for victim mobilization of law were also shaped by both the national and organizational cultural context. These findings have implications for Institutional Theory in the sociology of organizations, for the sociology of law and for research in the area of sexual harassment.
520 # $a This dissertation examines the relative contributions of national context and organizational context on understandings of law within organizations. I investigate the way law is understood and implemented within organizations using a cross-national design in two nations with similar sexual harassment laws. Because legal definitions of harm in the area of sexual harassment are strikingly similar in the U.S. and Austria, this design allowed me to separate legal definitions of sexual harassment from the cultural factors transforming legal statutes into legal understandings.
