Megamedia consolidation has brought to the forefront the relationship between private power and free speech. In increasingly heated terms, rhetors have taken widely divergent positions on the extent to which private power threatens freedom of expression, the responses (if any) that government should take, and the constitutionality of doing so. Despite their differences, rhetors share the assumption that the rationale for protecting free speech is based in its consumption; as a result, the public interest is narrowly construed in terms of providing options for an audience. This commonplace, labeled the “armchair perspective” here, neglects the interest of individual human beings in self-expression. Instead, it emphasizes the “service” provided by a system of freedom of expression that has been effectively commodified. What explains its prevalence, and what are the implications for the fight against consolidation?

520 # $a The dissertation examines the Supreme Court's First Amendment jurisprudence by studying the interaction between the Court and American society, with particular attention to certain landmark cases. It moves beyond the language of the opinions themselves to consider internal structural factors (e.g., the language of the First Amendment, the late gestation of free speech jurisprudence, and the process by which cases reach the Supreme Court) and external social, political, and economic factors (e.g., the rise of consumer capitalism, the quasi-governmental, quasi-human treatment of the corporation, and the broadcast model and its adaptation by radio and other “new media”). Discussion of contemporary judicial and non-judicial manifestations of the armchair perspective demonstrates how its persistence frustrates efforts to reform existing media structures. Securing reform requires clarifying the premises of the theory of expressive freedom; in particular, it requires emphasizing the individual speaker's interest in speaking freely. This dissertation suggests that one way of engineering this reversal is tracing the sources of the inferior alternative, the magical armchair.
