Civil juries generally have one or two decisions to make: on liability and damages. Prior research has indicated that the amount a plaintiff requests in damages affects judgments about the defendant's liability (Chapman & Bornstein, 1996) and that the amount a defendant recommends affects the size of damage awards (Marti & Wissler, 2000). This research investigated how jurors perceive and utilize defense award recommendations in deciding whether or not a defendant is liable and what to award the plaintiff for his pain and suffering. The strength of the plaintiff's liability case against the defendant and the defendant's award recommendation (presence or absence as well as the amount) were manipulated in a premises liability case. Compared to jurors who did not hear a defense recommendation, jurors who heard a defense award recommendation were more likely to find for the plaintiff on liability, but only when the evidence strongly favored the defendant. General damage awards of those who found for the plaintiff were higher than awards of those who found for the defendant. Awards were anchored on the defense recommendation, with an extremely low recommendation producing a diminished effect on awards. Jurors who heard a defense recommendation were less likely to believe that a defense award recommendation is an admission of liability than jurors who heard no defense recommendation. Liability evidence influenced assessments of the plaintiff's injuries, indicating possible fusion of liability and damages decisions. Based on the findings, implications for civil procedure policy are discussed.
