The influence of litigation on the right of a local school board to select its curriculum was the subject of this research. Specifically, the research investigated whether or not a court case, <italic>Freiler v. Tangipahoa Parish Board of Education</italic> (1999), chilled the right of the Tangipahoa Parish Board of Education to select its curriculum.

The research suggested several safeguards likely protected the right of the board to select curriculum from being chilled. The low cost of the litigation, the role of the state in the curriculum selection process, and the parish textbook adoption committee likely prevented the <italic>Freiler </italic> case from having a chilling effect on the right of the board to select curriculum.

This study revealed that textbook screening, avoiding controversy as a primary mechanism of the textbook adoption committee, the philosophical bent of the board, and the ability of the curriculum selection process to endure over time affect curriculum selection. These factors, as well as the probable safeguards that protected the right of the board to select its curriculum have profound implications for curriculum studies. A clear understanding of how these factors impact curriculum selection is necessary to accurately assess the curriculum selection process, defend curriculum selection practices, and make informed recommendations for improvement. Ultimately, these factors play a major role in determining which textbooks find their way into the classroom and what is taught.
