Summary:	近年來，我國少子化之現象有日益惡化之趨勢，少子化之情況若不改善，不僅將導致勞動人口減少、人口結構老化、年輕世代之經濟負擔增加，更會影響國家整體經濟成長率、發展力與競爭力，是如何改善少子化之問題，已是目前刻不容緩之課題。少子化之成因，主要可分為社會因素及經濟因素，如育兒經濟負擔過重，機會成本過高等，其中育兒與工作不能兩全可說是育齡男女晚生、少生甚至不生之主要原因。肇因於現有之勞動保護制度之不足，育齡男女在育兒與工作難以兼顧之情況下，常被迫在工作與家庭衝突中選擇，結果往往是犧牲後者而選擇前者，以致少子化危機日趨嚴重。如何強化育齡男女之勞動保護，使其等能在無後顧之憂下，得以自主實現生育權，洵為本研究之重點。本研究首先將說明少子化之現象、成因與影響，並從育兒與工作兩難之角度探討父母基本人權之保障，進一步檢討我國對育齡男女提供之相關勞動保護措施與實施現況及現行勞動法制不足因應少子化現象之處。為解決上開問題，實有必要建構育齡男女得向國家請求足以充分實現生育權之勞動保護之法理論基礎，並從勞動法制與積極生育權結合之觀點落實育齡男女之生育權。其次，再對台灣育齡男女相關勞動政策、措施提出檢討與展望，並以亦同樣面臨少子化危機之鄰國日本所實施之少子化對策加以分析比較。最後，再針對我國育齡男女之勞動保護相關政策提出建議，希望能營造友善之職場環境，建構兼顧育兒與就業之工作條件，並輔以適當之配套措施，如發放育嬰津貼、普及托育設施、補助托育費用等，以緩解少子化現象。
