    摘要註: 近年來國際能源危機造成國內建材成本鉅幅漲跌,而國內的營造市場因此興起了物價調整的議題。因營建工程之投資金額龐大,履約期限長,承擔之風險高,常發生各種不確定因素而導致物價有所波動,造成承攬廠商之成本提高,再加上長期缺乏一套公平合理的物價調整機制,致工程物價調整爭議事件不斷,甚且因無法承擔物價上漲之風險而倒閉無法完成工程。 工程承攬契約在承攬廠商得標或締結契約時,承攬總價即已確定,而承攬商依照施工排程或工程進度表於各施工階段購買材料時,往往與得標或締結契約時常距離有數月至數年之久,而期間的物價波動常使得原本約定的價金無法反應承攬廠商購料時之成本。在此情況下,承攬商進而向政府陳情甚至訴諸於法院。故工程主管機關有鑑於問提之嚴重性,而陸續頒訂補償措施。 但補償措施制度不見得公平,再加上有些工程主管機關為便於工程執行而拒絕辦理物價補償。而承攬商將訴求訴諸法院時之需有其訴求依據,然請求權基礎為何,是政府所頒布之物價指數調整處理辦法或是政府採購法上之公平原則或是民法情事變更原則?實務上目前尚未有一致的見解。故本文將蒐集法院及實務上相關判決,針對物調辦法、承攬契約內明文不辦理物價調整、承攬人之請求權基礎等法律問題進行剖析,比較其優劣,並嘗試提出解決方法。 Recent years ,the international resource crisis caused the materials price of construction increased rapidly . hence, the issue of“The Research of Price Index Adjustment Systems for Public Construction ”is discussed and disputed in public construction contract. because the construction have to been inputted tremendous amount of money and resource ,spent long time to construct ,as a result, contractors are subject to take more commercial risks than others engineering field.Additionally , lacks of a reasonable formula(method) for price index adjustment for a long period, the disputes and claims for compensation happened frequently. Some contractors are even bankrupted while they can’t afford the commercial risk to achieve the contract’s job.The total price of a construction contract are decided at the time point of bid winning or contract signing , however when the contractor prepared to purchase the materials by engineer schedule, it perhaps has passed a long time from bid winning or contract signing, the bid winning total price can’t be readjusted to accord with the market price index fluctuating between this period . Contractors at the situation, which can not afford the huge financial loss often resort the disputes to litigation way. Therefore, the government executive department sense the gravity of the issue that promulgate series approach to solve these disputes.However, the series approach perhaps not be completely fair and reasonable. Additionally , some situation exists difficulty of contract execute. As a result , contractors are resort the disputes to litigation proceeding .In litigation proceeding , which requests of the legal foundation can be used at the of court situation? By the measures that executive department promulgate? or principle of Circumstances change of civil law? Until now ,it has not been judged Identically. This article wish can collate the announce a verdict、point of dispute to compare these view point and try to research the feasible way for two side contractors.
