Summary:	民間信仰在台灣社會傳承著重要文化歷史背景，每一社區所敬祀的神明都有其特殊的「神聖性」典故，多元的祭祀文化與「功利性」的本質，則是民間信仰的主要特徵之一。社區型民間信仰宗教寺廟的設立、經營實務中所遭遇宗教行政法律適用性的問題，行政機關經常出現不當的管制措施，大法官釋字573號文強調:「人民之宗教信仰自由及財產權，均受憲法之保障，對行政機關宗教行政作為有明確性的指示必需符合憲法精神。」。非營利組織之宗教慈善團體中-「法人」的監督與管理與自民國十八年實施的「寺廟監督條例」法律行為效果不一，宗教寺廟設立、經營實務的方向也就不同。本文研究探討由非營利組織團體成立的概況與宗教行政所面臨的衝突，再由社區民間信仰寺廟的經營實務所遭遇的爭議問題做法律分析，並對法規範衝突與調和提出探討與建議。 Folk beliefs reflect important cultural and historical backgrounds in Taiwan. Gods and goddesses in each region have their special sanctity allusions. Diverse worship cultures and utilitarian essence are the main characteristics of Taiwanese folk beliefs. Problems of the applicability of the administrative laws concerning religion occur when establishing and managing temples: The administrative agencies often implement inappropriate controlling measures. According to the Grand Justices' constitutional interpretation (CI) No. 573, people’s freedom of religious belief and property right are under the protection of Constitution. The administrative agencies have to conform to spirit of Constitution when directing the religious administration. The effects of supervision and management of artificial person, a non-profit corporation, are inconsistent with the effects of Act of the Supervision of Temple, which was put into practice in 1929. Therefore, the directions on the establishment and practical management of temples differ. This study explores general conditions of the established non-profit institutions and the conflicts that the religious administration faces. Additionally, the controversial issues in laws and regulations when practically managing temples in communities are analyzed. Finally conflicts and negotiations between laws and regulations are discussed, and suggestions are made.
