Summary:	本文運用管制革新的方式對交通管制法規進行探討，檢討道路交通管理處罰條例中對於罰鍰的立法類型。利用問卷實際訪問第一線執勤員警，依據多年來在工作上的經驗及所學，評價各種交通違規行為對交通安全、交通效率的影響程度，並深入訪談交通法規之專家學者，藉以探討現訂處罰條例所規範的交通違規行為，對交通「安全」與「效率」危害之嚴重程度的相關性，輔以管制革新的觀念，對於影響或危害交通不同程度加以分類，檢討其訂定的統一裁罰標準及分析處罰標準與交通危害之相當性，並簡化其處罰級距，使交通違規行為嚴重度與處罰標準能在專業性、整體性、時代性、社會性與技術性等考量下，訂出合理的交通法規處罰標準與分類，使危害程度與處罰標準具備一定之相當性，作為交通主管機關從事交通管理與交通法規立法及地方治理的參考。 In this paper, we tried to review the type of legislation of the Road Traffic Regulations on Administrative Penalties for fines. According to the Questionnaire survey of the police officer, evaluate various traffic violations on traffic safety, traffic efficiency, impact, and in-depth interviews by experts and scholars of the traffic laws. In order to explore its present regulated by the penalties for traffic violations, the severity of the hazards of transportation "safety" and "efficiency", supplemented by the concept of regulatory reform, the varying degrees of impact or endanger traffic classification, and traffic hazards of equivalence and simplify their punishment level from the serious traffic violations and penalties standards in professionalism, integrity, the times, social and technical and other considerations set reasonable traffic regulations punishment standards and classification. By this research of the degree of harm and punishment standards, get some reference to the transport competent authorities and local governance.
