Summary:	公共工程之程序主要為主辦機關先行辦理設計監造技術服務契約，待設計完成後始招標施工廠商以施作工程。而行政院公共工程委員會針對技術服務採購所訂之公共工程技術服務契約範本約定：「委託規劃、設計、監造或管理之契約，乙方(即工程顧問公司、技師事務所及建築師事務所等)因規劃設計錯誤、監造不實或管理不善，致甲方(即主辦機關)遭受損害，乙方應負賠償責任。」，故於乙方規劃設計瑕疵或監造不實而造成業主(即主辦機關)之損害時，須對業主負損害賠償責任。本文將探討及釐清公共工程設計瑕疵或監造不實之民事爭議問題，包括公共工程設計監造契約之法律性質、設計瑕疵或監造不實之認定標準、具體爭議案例之評析、公共工程設計瑕疵或監造不實之民事責任所隱藏的若干問題，予以探討釐清，並針對上述目前公共工程設計瑕疵或監造不實之民事爭議問題在實務上所發生之嚴重問題提出一些建議。 The public works program as the authority in advance to handle the design and supervision services contract, start bidding construction be designed facilities for engineering manufacturers.
