Summary:	我國全民健保自1995年開辦以來，其中健保藥費之支出乃逐年成長，且全民健保藥物給付項目及支付標準（即所謂「藥價基準」）除攸關保險對象之就醫權益外，亦涉及保險醫事服務機構及藥品供應商之營業利益。本研究除就藥價黑洞（或稱藥價差）之議題加以探討之外，並針對我國全民健保藥事制度之相關法律及法規命令加以分析，自保險人、保險對象、保險醫事服務機構及藥品供應商等當事人之不同面向，研究全民健保藥事制度之相關法規範（包括藥品給付項目、事前審查、支付標準及藥價調查制度），試行對我國全民健保規範之藥事制度所干涉之基本權作違憲審查，最後就現行全民健保法尚有何缺失之處，提出建議修法方向。 Ever since National Health Insurance (NHI) has been put in operation in 1995, of which, the NHI medicine expenditure has been gradually rising year after year, and the benefit items and payment standard (i.e. the drug list and payment scheme) of the NHI medicine not only affect the right to receive medical care for the insured, but also get involved in the business interests of the insurance medical service organizations and medicine suppliers. The goal of this study is to investigate the issues of the drug price black hole (or medicine price difference), also, to analyze the related laws and regulation orders of the Pharmaceutical Jurisprudence within NHI. This study will start from the different aspects of the insurer, the insured, the insurance medical service organizations and drug suppliers to study the related legal regulations (including the drug payment items, prior review, payment standard, and drug price survey system) of the NHI system to attempt to proceed with unconstitutional inspection for the pharmaceutical jurisprudence of NHI involved in basic rights for medical care, finally, to give comment on the amendment of law at any fault of the National Health Insurance Law.
