政風機構歷經數次變革,從安全單位、人二單位、到政風單位,歷次組織之轉變可以發現政風機構均被賦予肅貪之職責,尤其在100年間,因陸續發生重大貪瀆弊案,鑑於政風機構肅貪能量之不足,法務部推動將政風司改制為專責廉政機關,由是催生了法務部廉政署。然檢視政風機構歷次變革,尤其廉政署係由政風司直接轉型成立,但可以發現政風機構在歷次變革中,其法律定位及職權均未改變,法律定位上屬機關的內部單位,對於貪瀆案件也僅擁有行政調查權。既然在歷次變革,政風機構並無本質上的改變,因此本研究嘗試從政風機構的行政調查著手,來探究政風機構行政調查的涵義及法律上的性質,尤其在廉政署成立後,政風機構對於貪瀆案件發動行政調查上有何差異。並透過亞洲在肅貪方面成功之外國廉政機構(香港、新加坡)的執行經驗作為一借鏡參考,以及實際從事廉政工作之公務員(含政風人員及廉政署之廉政官、廉政專員)對於目前政風機構在肅貪工作上能有何強化作為做一深度訪問探討。藉由從研究政風機構的行政調查著手,透過這些外國經驗制度比較,及歸納深度訪談的意見,期能就政風機構在肅貪功能上充分發揮的相關條件,提出制度面、政策面等建議,作為未來政風機構組織再改造,肅貪能量再強化的參考。 Government Employee Ethic Units (“GEEU”) have gone through multiple transformations, from Security Units, Bribery Investigation Units to currently developed Employee Ethics Units. These organizational changes made it clear that GEEU is solely responsible for eradication of corruption, especially over the last one hundred year when there has been several significant corruptions cases occurred. In view of insufficient resources within GEEU on the aspect of anti-corruption mechanism, Ministry of Justice promotes to change GEEU to a fully responsible anti-corruption unit. As a result, the organization so called Agency Against Corruption (“AAC”) is established under Ministry of Justice. However, looking at the GEEU transformation history, the roles and responsibilities of GEEU, and now called AAC, were never being changed based on the expectation or being clearly defined during the transformation. GEEU/AAC is still being viewed as Internal Administration Unit in the hierarchy and only has the right of procedural investigation on reported corruption cases.Having said this, although GEEU fundamental roles and responsibilities have not been changed or clearly defined, this research is aimed at studying GEEU’s processes and procedures of Administrative Investigation and exploring the meaning of such procedures and its regulatory enforceability. Especially after the AAC is established, how much difference it demonstrates on GEEU procedures when starting to investigate an anti-corruption case. We also benchmarked with a few successful foreign GEEU in countries around Asia Region, such as Hong Kong, and Singapore and leveraged their lessons learnt and experiences. We also interviewed a few government officers who actually worked on Ethics Investigation, including people who are Agent, or Special Agent of GEEU and AAC, as to how to strength the current anti-bribery investigation.Researching from GEEU Administrative Investigation procedures and processes, comparing with foreign experiences and summarizing the opinions collected throughout the interviews, we look forward to providing a great overview of how GEEU can be more effectively leveraged by current legal system, and also provide a few systematic and strategic recommendation in the event of potential future GEEU transformation as well as strengthening the resources of anti-corruption in the future.
