摘要註:	早期的民俗療法師在執業的招牌上所掛的名稱大部分均稱為「國術館」或「接骨所、院」。目前國內從事推拿、整脊、氣功、拔罐等民俗療法者，人數高達20萬人，為了有效管理，衛生署將這些人都歸「傳統整復推拿」。在時下法令未明朗下，這十幾萬人從事傳統民俗推拿整復從業員的工作權益，長期的被忽略或歧視，而從事民俗療法之人員都透過相關之民俗推拿整復勞工職業訓練人等民團體工會、協會取得結業證書，卻始終沒有政府相關單位認定的證照。因此民俗文化的傳承和民俗醫療考照成為重要的課題。此外，民俗療法未來是否有機會成為另一個兼具養身的顯學？有沒有機會與其他產業合縱聯合？甚至，未來是否可以借工會組織之整體性合作力量，促進政府檢視現有法規，以達到從業者與消費者雙贏的環境。本研究遂擬定了三個研究問題: (1)當前從事民俗調理從業人員面臨的最大困境為何？目前的政府相關法令規定為何？(2)是否有可能透過工會體制協助民俗調理從業人員取得證照？(3)民俗療法的未來前景與商機？本研究係以傳統民俗療法中的推拿整復為調查及研究對象，以台灣南部推拿整復相關協會的負責人或是會員為訪談對象，透過文獻探討、焦點團體訪談與深度訪談來分析傳統民俗療法之考照制度及其未來商機本研究結果發現相關行業的民俗療法從業人員的看法相當一致，他們需要一套完整的考照制度，以防他們之後工作權被剝奪。但是鑒於目前的情勢，要馬上由衛生署來主導、考試院來協助考試似乎無法馬上得到成效，因為這會牽涉到法令的修改，需要花相當多的時間來將其付諸實行。因此，本研究建議讓相關工會參與命題，提供該產業的專業知識讓勞委會做為參考，進而使考照試題更具有公正性與專業度。 Most of the signboard names of the early traditional therapists are largely called as “Kung Fu Institute” or “Broken Bone Set Institute.” The number of the traditional therapists engaging massage, chiropractice, Qigong, and cupping amount up to 2 million. In order to make an effective management, the Department of Health makes these people belong to “Traditional Rehabilitation Massage.” Under the unclarity of the current laws, the million traditional therapists’ work rights have been long ignored or discriminated. The traditional therapists do obtain the certificates from the related labor unions or associations, but there’s no certificate recognized by the government.Therefore, the passing-down of the culture and the medical license-obtaining become important issues. Besides, does the traditional therapy have the opportunity to become noted school with the health-preserving in mind? Or does it have the opportunity to cooperate with other industries? Or even in the future, could the integrated power of the labor unions help promote the government to pay attention to the current laws so as to achieve the dealer-consumer win-win condition? This study then draws up three research questions: 1) what’s the predicament the traditional therapists meet, and what are the government laws and regulations? 2) Is it possible for the labor unions to assist obtaining the certificates? 3) What’s the future of the traditional therapy and its business opportunity? This study takes rehabilitation massage within the traditional therapy as the research target, and the people in charge or the members within the related rehabilitation massage associations as the interview target. Through the literature review, focus group interview and in-depth interview, this study analyzed the traditional therapy license-obtaining system and its future business opportunity.From the results, this study found out that the traditional therapists’ viewpoints are of consistency. They need a complete set of license-obtaining system so as to prevent their work right from being deprived. However, because of the current situation, being guided by the Department of Health and assisted by the Examination Yuan could not get immediate effects for the reason of involving the law-revision and it takes a long time to get it implemented. Therefore, this study suggests the related labor unions involve the question-formulating and offers the industry’s professional knowledge to the Council of Labor Affairs, making the questions fairer and more professional.
