    摘要註: 我國國有不動產為中華民國所有之財產,即為全民之資產,因此我國國有不動產的出售可謂國有不動產管理機關本於權責為中華民國國民行處分行為,同時國有不動產的出售常負有政策任務,基於此特殊性,其買賣相對於私有不動產的買賣有所差異,我國國有不動產出售主要規範見諸於國有財產法,其中第五十二條之二規定係配合國家政策將國有不動產以低於市場價格讓售與符合一定資格民眾更為獨特,其目的為何?執行方式是否確實達成立法目的?有無檢討改進之處?爰引發研究探討動機。並非我國所有國有不動產均可以出售,依其為公用不動產或非公用不動產而不同,因此,本文第二章就我國國有不動產之意義及類型介紹討論;第三章則對我國國有不動產出售類型加以分析;為深入了解國有財產法第五十二條之二形成背景、立法決策與目的於第四章探討該法條立法背景並介紹歷次修法歷程;第五章、第六章分別對國有財產法第五十二條之二規定、相關配套措施及實務執行加以研討剖析並列舉案例對照分析。第七章則基於前述章節研究對該法條規定及措施予以檢討,最後嘗試於文末提出建議。 The national real estate is the property of the Republic of China, also the assets of the people. Consequently, the sale of the national real estate can be said as implementing the disposition of assets for the people of the Republic of China by the administration authority of national property on the basis of liability. Frequently, the sale of national real estate is accompanied with policy task. In view of this particularity, it is quite distinct from the private transaction. The sale of national property mainly is based on the stipulation of National Property Act. In Article 52-2 of National Property Act, which is found unique, it specifies, in accordance with the national policy, to have the national real estate sold for some qualified people by the value under market price. What is the purpose of this article? Does it achieve the goal of the law on execution actually? Is there any dispute for review or improvement? This is the motive for the research.Not all the national real estate are for sale. It differs by public and non-public use property. Hence, in the chapter 2 of the study, we discuss the meaning and the categories of the national real estate. In the chapter 3, we analyze all sorts of the national assets transaction. To figure out thoroughly the background, the legislation policy and the purpose for the Article 52-2 of the National Property Act, we study it in the chapter 4, also introduce the progress of the law revision in all previous sessions. In chapter 5 and 6, separately, we look into deeply the rule, the relevant supporting policies and the practical execution for the Article 52-2, furthermore, some specimen are listed and analyzed as comparison. In chapter 7, we make examination on the subject rule and measure from the previous chapters. Finally, we try to make recommendation in the end of the thesis .
