Summary:	摘要人民團體係一有組織的團體，可區分為「政治團體」、「職業團體」與「社會團體」等三大類。本論文以職業團體中的商業團體與社會團體為主要研究對象。第一、針對有關商業團體「強制入會」規定的合理性，以及是否有將其修正為「自由入會」的方式作為探討的重點；第二、探討現行社會團體之設立制度「許可制」是否會對於人民在籌組社團的過程中妨礙人民的籌組。本論文係透過所選定之訪談對象，藉由訪談所得的結果瞭解相關人員間對於現行制度之看法與差異。經過訪談發現：一、社會團體的設立制度方面，不論是主管機關的相關人員或是已立案的團體，對於外來有可能採行的新制度「登記制」仍然懷有不安與不確定的疑慮，且對現行制度仍是抱持肯定的態度；二、職業團體(商業團體)強制入會部分，相關受訪者則是呈現贊成與反對兩極化的看法。為使團體能夠健全的發展，本篇論文將分別針對現行社會團體設立制度與職(商)業團體強制入會的規定之研究提出個人相關建議，並且希望經由本篇論文之研究能作為將來地方政府對於輔導人民團體之參考。 AbstractCitizen's Organizations an organized group, can be divided into "political groups "、 "occupational groups" and "social groups " such as three categories. In this thesis, occupational groups in business groups and social groups as the main object of study. The first, for business groups about the "mandatory membership" requirement is reasonable, and whether there is to be amended to "free membership " as a way to explore the focus；the second, explore the establishment of the existing system of social groups "permission system" whether it will generate unnecessary restrictions for the people in the process of organizing associations, so as to obstruct the people organizing associations.This thesis is to selected by the interviewee,the results obtained through interviews with relevant personnel to understand the inter-views with the difference between the present system. After interviews that：first, the establishment of the existing system of social groups, whether competent authority personnel or the group has placed on file, for the future ,it is possible to adopt a new system of "registration system" still harbor doubts unease and uncertainty, and still hold positive about the present system；second, about the occupational groups (business groups) mandatory membership,related interviewees are rendered in favor of and against the views of polarization.For the groups can healthy development, this thesis research will be to establish a system with the occupational (business) groups of mandatory membership requirement and the existing system of social groups to give personal recommendations, and hope through research of this thesis can be used as counseling for the future of local government and citizen's organizations in the reference
