The occurrence of prison sexual violence not only disrupts the safety of the institution but has been linked to several mental and physical consequences for victims, as well as preventing successful re-entry into society. For these reasons, it is essential to determine what contributes to sexual violence in prison to prevent it from occurring. Federal legislation – the Prison Rape Elimination Act of 2003 (PREA) – was created to detect, prevent, and reduce the occurrence of prison rape. However, PREA requirements regarding the use of screening tools to help prevent such violence have relied on research that has primarily used samples of incarcerated men and qualitative methods. This dissertation overcomes the issues of previous studies on sexual violence by using two large samples of incarcerated men and women and examining a wide array of potential predictors of both sexual victimization and perpetration. Survey and official data were used to assess the prevalence and predictors of sexual violence for each sample. Ultimately, this study sought to create preliminary PREA-compliant risk assessment tools to help correctional staff identify potential victims and perpetrators of sexual violence upon intake into a facility. The findings from this study suggest that women’s and men’s risk of being sexually victimized and perpetrating sexual violence in prison differ and that the PREA mandate has neglected pertinent risk factors for such violence.
