This study examined the relationship between incident response and privacy policy in knowledge, time, and performance. The problem this research examined was that the new privacy protection policies being introduced have made it more difficult to collect evidence within incident response and e-discovery. The states examined were Virginia, Kansas, California, Mississippi, Colorado, New Jersey, Utah, North Carolina, Connecticut, and Massachusetts. Individuals who were incident response and forensics professionals were surveyed from these states. The FTIS framework was used within the study to structure the survey and the impact scope. The individuals were then asked specific questions about whether they believed there was an impact on the time, performance, or knowledge of new privacy policies and incident response. This quantitative correlational study provided analysts, examiners, and other researchers insight into how current privacy policies may affect the different aspects of incident response. To do this, a χ2 analysis was used to see if the results indicated a statistical significance between incident response and privacy policy related to the overall incident response activities. This means that an incident response will have more impact as more privacy policies are created.
